I PRAY FOR THESE DIRECTORS AND THANK YOU, LORD, FOR THEM, FOR THE TIME THEY GIVE, AWAY FROM FAMILY , SO THAT OUR COMMUNITY CAN BE WHAT IT NEEDS TO BE.

AS ALWAYS, NICE

TO HAVE YOU, SIMON. >> GOOD EVENING AND THANK YOU FOR ALLOWING ME TO SPEAK, TONIGHT. TWO THE BOARD OF DIRECTORS, TO MEMBERS OF PUBLIC , AND TO THE TOWNSHIP STAFF. I WANTED TO GIVE YOU A QUICK UPDATE ON WHAT'S GOING ON FOR THE SPRING SEASON FOR HTX SOCCER. I AM THE DIRECTOR OF SOCCER OPERATIONS FOR THE CLUB, SO I THOROUGHLY ENJOY COMING IN HERE TO GIVE YOU ALL A QUICK THREE MINUTES ON WHERE THE CLUB IS GOING FOR THE SPRING . WE STARTED THE SPRING SEASON LAST WEEKEND WITH THE TOURNAMENT , THE BOY'S PREMIER CUP, 2024. IT'S BEEN GOING ON FOR SOME TIME. IT'S A STARTING POINT FOR THE BOYS SIDE OF THE CLUB TO MOVE FORWARD. IT'S A PRESEASON EVENT, WHICH GETS US MOVING TOWARD THE LEAGUE SEASON. ABOUT 150 TEAMS CAME IN TO THE LOCAL AREA AND WE USED THE LOCAL HOTELS , AS WE'VE BEEN DOING FOR MANY YEARS, TO HOUSE THESE TEAMS. WE USE THE THREE NIGHTS WE HAVE AVAILABLE AND IT WAS A FRIDAY NIGHT, SATURDAY, SUNDAY AFFAIR, AND IT WAS A REAL POSITIVE WAY TO KICK OFF THE SEASON FOR THE BOYS SIDE. THIS COMING WEEKEND, WE DO THE SAME WITH THE GIRLS, SO WE WILL HAVE TEAMS COMING IN FROM DALLAS, SAN ANTONIO, AUSTIN , OF THE YOUTH SOCCER CLUBS WE COMPETE WITH AND OUR PARTNERS. WE WILL HAVE THEM THIS WEEKEND, AND LOCALLY , SATURDAY AND SUNDAY , AT BRANCH AND GOSLING. WE LOOK FORWARD TO GETTING THROUGH THAT. IT WAS COLD LAST WEEKEND, IT THIS WEEK WE'VE HAD RAIN. WE'VE HAD CHALLENGES, THERE, BUT WE ARE VERY FORTUNATE TO BE PLAYING ON TURF. THE TURF FIELDS MOVE THE PROGRAM FORWARD, SO WE DO APPRECIATE THE SUPPORT, THERE.

THE NEXT BIG PROGRAM THAT WE ARE STARTING IN FEBRUARY IS OUR GRASSROOTS , WHICH STARTS FEBRUARY 10TH, WE ARE PUTTING ALL THOSE YOUNGSTERS INTO THE SYSTEM AND REGISTERING ALL OF OUR VOLUNTEER COACHING STAFF . THAT WILL GO UNTIL THE MIDDLE OF APRIL AND WE ARE EXCITED TO MOVE THAT FORWARD BECAUSE THOSE ARE VERY MUCH THE LOCAL RESIDENTS. WE'VE GOT 1400 PLAYERS AS PART OF THE PROGRAM AND 200+ COACHING STAFF VOLUNTEERING THEIR TIME. WE ARE LOOKING FORWARD TO THE SPRING SEASON AND HOPING THE RAIN WILL STAY AWAY. I THINK IT WILL GET BETTER OVER THE WEEKEND AND WE LOOK FORWARD TO PROVIDING A SUCCESSFUL AND ENJOYABLE SPRING SEASON OF

SOCCER. THANK YOU. >> THANK YOU, SIMON AND THANK YOU FOR ALL THAT YOU DO. THAT BRINGS US NEXT , TO LAURA.

LAURA NORTON. >> YOU ARE RIGHT , AFTER LAURA.

[00:10:04]

>> THANK YOU. MECH I AM LAURA NORTON AND I AM HERE WITH A FOLLOW-UP BID WE WERE BOTH HERE IN OCTOBER AND IN OCTOBER, ED SHACKLEFORD WAS HERE AND HE GAVE A PRESENTATION REGARDING THE REMEASURING . AT THAT MEETING, THIS BOARD ASKED TO CONTINUE MONITORING THE FAULT ALONG RESEARCH FOREST DRIVE, AND WE THANK YOU FOR THAT , BUT IT DID NOT GO WELL AFTER THAT. THE NEXT WEEK , ED SHACKLEFORD WENT BACK TO HIS GRP MEETING AND RECOMMENDED THAT THEIR BOARD DISCONTINUE THE END OF SUMMER REMEASURE. I WOULD LIKE FOR YOU TO HAVE THAT EXPERIENCE OF LISTENING TO WHAT EXACTLY HE SAID TO HIS BOARD, AND I KNOW THAT MY COLLEAGUE HAS SENT YOU ALL AN EMAIL, TODAY, AND AT THE BOTTOM, YOU WILL FIND AN AUDIBLE CLIP TO LISTEN TO . IF YOU GO TO THE MARKER, 12:43, IT WILL START RIGHT THERE WERE ED SHACKLEFORD SAYS "YES ," AND ADMITS THAT THE BOARD ASKED THEM TO CONTINUE MEASURING BUT HE RECOMMENDS THAT THEY NOT AND HE JUST THROWS OUT YOUR RECOMMENDATION. ANYWAY, WORSE, SINCE THEN, AS JRA HAS PUBLISHED THE DATA FROM THE LAST TIME THEY DID DO A LAND SURVEY. THEY'VE BEEN RELET TO PUT THAT REPORT ONLINE, BUT THE DATA IS OUT THERE AND I DID A PUBLIC OPEN RECORDS REQUEST TO GET THE GEOLOGISTS REPORT ON THAT DATA. WHAT IT SHOWS IS THAT SUBSIDENCE HAS TRIPLED . THAT'S INCREDIBLE. I HAVE THE WEBSITE , STOP OUR SINKING.COM, AND I HOPE YOU WILL JOIN MY EMAIL DISTRIBUTION LIST, BUT IN THE COMING WEEK, I WILL SEND A LETTER OUT TO MY EMAIL DISTRIBUTION LIST GRAPHICALLY SHOWING HOW THIS SUBSIDENCE IS THE . WE ARE BACK TO SINKING AT PRE-GRP RATES OF HALF AN INCH A YEAR. WE ARE DEVELOPING HIGH-RISES THAT WILL USE MORE GROUNDWATER, AND THIS SUBSIDENCE IS IRREVERSIBLE AND UNEVEN AND WILL CAUSE FLOODING IN PLACES THAT DID NOT FLOOD BEFORE. AS JRA DOES NOT WANT TO MEASURE THE FAULT ANYMORE. THAT'S THE WRONG DIRECTION TO GO. I AM LOOKING FOR A BOARD , ANYONE, TO ADVOCATE FOR RESIDENTS . WE ARE SITTING IN THESE HOMES AND THE SILENCE SUBSIDENCE IS DOING US IN. THANK YOU DID

>> THANK YOU FOR BEING HERE AND BRINGING THAT TO OUR ATTENTION. THAT BRINGS US TO NEXT , WITH THE WOODLAND COMMUNITY MAGAZINE. NICE TO HAVE YOU.

>> ALL RIGHT. GOOD EVENING. TONIGHT, I AM GOING TO TALK ABOUT THE WOODLANDS COMMUNITY MAGAZINE , THE AGREEMENT THEY HAVE WITH THE WOODLANDS TOWNSHIP IS COMING UP FOR RENEWAL AND THIS IS ITEM 11 ON THE AGENDA. I WILL READ FROM THE AGENDA TO GIVE YOU SOME BACKGROUND. THE BACKGROUND , IN THE PARTNERSHIP WITH THE OUTSOURCED PUBLISHER, THE WOODLANDS TOWNSHIP PRODUCES THE WOODLANDS COMMUNITY MAGAZINE WHICH IS MAILED THE FIRST OF EACH MONTH TO THE RESIDENTS. THE PARTNERSHIP WITH THE PUBLISHER BEGAN OVER 26 YEARS AGO WITH ONE OF THE PREDECESSOR ORGANIZATIONS .

UNDER THE PARTNERSHIP AGREEMENT, THE TOWNSHIP IS NOT FINANCIALLY RESPONSIBLE FOR THE MAGAZINES LAYOUT , PRINTING, OR DISTRIBUTION. THE PUBLISHER IS SOLELY FISCALLY RESPONSIBLE FOR THE LAYOUT, PRINT, AND DISTRIBUTIONAL COST. THE SELLING OF THE AD BY THE PUBLISHER COVERS THESE COSTS AND THE PUBLISHER HAS RIGHTS TO THE AD REVENUE. CONTENT IS PROVIDED TO THE PUBLISHER BY THE TOWNSHIP. IN DECEMBER 2023, THE PROVIDED NOTICE OF INTENT TO TERMINATE THE AGREEMENT . THE FEBRUARY 2024 ISSUE WOULD BE THE FINAL ISSUE PUBLISHED BASED ON PRIOR PARTNERSHIP. BASICALLY, THE MARCH ISSUE IS GOING TO BE FOOTED BY THE TOWNSHIP .

ACCORDING TO THE TOWNSHIPS 2022 COMMUNITY SURVEY, 63% REPORTED THE WOODLAND COMMUNITY MAGAZINE AS THE

[00:15:02]

PRIMARY SOURCE OF NEIGHBORHOOD INFORMATION. THAT'S HIGHER THAN ANY OTHER PUBLICATION INFORMATION SOURCE. PRINT DISTRIBUTION CAN REACH RESIDENTS WHO DO NOT ENGAGE WITH THE TOWNSHIP IN DIGITAL CHANNELS. WHILE WE'VE SEEN INCREDIBLE GROWTH ON SOCIAL MEDIA AND AN EMAIL DISTRIBUTION, ONLINE AUDIENCES ONLY ACCOUNT FOR A SMALL PORTION OF THE POPULATION. SO, BASICALLY WHAT YOU ARE VOTING ON , AND THERE'S A RECOMMENDATION BY THE TOWNSHIP, DIRECTORS CAN CONSIDER THESE THREE OPTIONS FOR THE DISTRIBUTION OF THE MARCH 2024 EDITION OF THE MAGAZINE. YOU CAN PRINT A 16 PAGE PUBLICATION AND MAIL IT TO ALL 35,000 RESIDENTIAL PROPERTIES IN AN AMOUNT NOT TO EXCEED 40,000 THROUGH A BUDGET AMENDMENT TO THE 2024 COMMUNICATIONS BUDGET . THAT IS OPTION ONE. YOUR SECOND OPTION IS THAT YOU CAN PRINT A POSTCARD WITH THE QR CODE TO THE DIGITAL PUBLICATION AND MAIL THE POSTCARD TO THE 35,000 RESIDENTS IN THE AMOUNT NOT TO EXCEED $16,000 THROUGH A BUDGET AMENDMENT TO THE 2024 COMMUNICATIONS BUDGET. THE OPTION I AM HERE TO RECOMMEND , WHICH I THINK WOULD BE THE BEST OPTION , BUT YOU CAN VOTE HOWEVER YOU WOULD LIKE, OPTION THREE IS TO PRODUCE A DIGITAL VERSION OF THE MAGAZINE AND PROMOTE IT TO THE TOWNSHIP DIGITAL CHANNELS AT NO ADDITIONAL COST. IT'S LIKE IF YOU COULD WRAP IT UP.

>> AT NO ADDITIONAL COST TO THE 2024 COMMUNICATIONS BUDGET.

I'M A BIG FAN OF THE MAGAZINE, I LOOK FORWARD TO THE MAGAZINE EVERY MONTH. I DON'T READ ONLINE. MY RECOMMENDATION IS FOR OPTION THREE BECAUSE IT WILL BE NO ADDITIONAL COST TO THE BOARD AND WILL ONLY , NO ONE WILL DIE IF THEY DON'T GET THEIR MARCH PUBLICATION OF THE MAGAZINE. THANK YOU.

>> THANK YOU. OUR LAST PUBLIC COMMENT , NICE TO HAVE YOU.

>> I JUST WANT TO SPEAK BRIEFLY TO THE HOMELESS ISSUE. I SAW THE CITY HAD PUT THAT ON THERE, I DON'T KNOW EXACTLY WHY OR WHAT'S GOING ON WITH THAT, BUT MY MAJOR POINT OF THERE'S ONLY ONE I CAN MAKE IS THAT IF YOU'RE DOING ANYTHING IN REGARD TO POLICY ON THAT, YOU SHOULD REALLY CONTACT THE COALITION FOR THE HOMELESS , THE WAY HOME, PART OF A HUD PROGRAM THAT CORRELATES TO HOW HOMELESSNESS IS HANDLED IN THE GREATER HOUSTON REGIONS. IF YOU DO ANYTHING WITH POLICY, I WAS KIND OF ON THE CAMPAIGN TRAIL WITH SOME OF YOU , AND WE HEAR A LOT OF THINGS FROM SOME OF THE PEOPLE WHO ARE REALLY UNINFORMED ON THE HOMELESSNESS ISSUE. AS SOME OF YOU MAY KNOW, I GO OUT EVERY THIRD SATURDAY IN FEED THE HOMELESS WITH MY CHILDREN BECAUSE MOST OF THIS PEOPLE ARE JUST LIKE ANYONE ELSE AND THEY ARE NOT DANGEROUS AT ALL. A LOT OF PEOPLE THINK OF SOMEONE ON CRACK COCAINE , BUT IF IN THE WORST CASE SCENARIO, THIS PEOPLE WHO ARE ON CRACK COCAINE, THE PARTIES SOLD WHATEVER WEAPONS THEY HAVE BEEN MOST OF THE PEOPLE I KNOW ARE TRYING TO IMPROVE THEIR LIVES. I KNOW A LOT OF THEM BY NAME, A LOT OF THEM, ONE IN PARTICULAR , HE FALLS ASLEEP.

HE CAN'T WORK BECAUSE HE HAS A DISEASE HE FALLS ASLEEP.

ANOTHER GUY HAD SEIZURES. ANOTHER GUY, I WISH I HAD A CHANCE TO TALK WITH THEM, I ONLY SAW HIM BRIEFLY, BUT AN ENORMOUSLY INTELLIGENT GUY. I WISH I COULD HAVE A GOOD CONVERSATION WITH HIM. A LOT OF THESE PEOPLE I KNOW , IT'S NOT WHAT YOU THINK. THEY ARE NOT DANGEROUS AND I KNOW A LOT OF THE COMMUNITY HAS THAT PERCEPTION. I KNOW THAT WHEN WE SPEAK OF THIS, WE NEED TO TALK IN TERMS OF, I'M AFRAID THAT THERE'S GOING TO BE A DEVALUING OF MY PROPERTY, RATHER THAN SOME OF WHAT I HEAR IS TALKING ABOUT PEOPLE IN AN UNLOVING AND UN-RESPECTFUL WAY , WHICH MOST OF THESE PEOPLE DO NOT DESERVE AND A LOT OF WHERE THEY ARE IS NOT A TOTALITY OF THEIR OWN DECISIONS. I WANT TO BRING THAT TO YOU AND I HOPE YOU WILL COORDINATE WITH THE COALITION FOR THE HOMELESS BEFORE YOU START MAKING POLICY THAT AFFECTS PEOPLE'S LIVES.

THANK YOU. >> THANK YOU. IT'S NICE

[6. Receive, consider and act upon reports from Village Association representatives;]

HAVING YOU. THAT BRINGS US TO AGENDA ITEM SIX, TO RECEIVE, CONSIDER, AND ACT UPON THE REPORTS FROM OUR VILLAGE ASSOCIATION REPRESENTATIVES. WE JUST HAVE ONE , MARIANNE, WHO'S ALWAYS HERE, AND THEN THERE IS A COMMENT ABOUT CREEKSIDE PARK FROM DIRECTOR BAILEY.

>> EXCUSE ME. >> I SAW THE NOTE.

>> OKAY. >> ALL RIGHT, DIRECTOR FRANKS.

[00:20:01]

WELCOME. >> GOOD EVENING. AS THE PRESIDENT OF THE VILLAGE ASSOCIATION, I WOULD LIKE TO GIVE YOU AN UP DATE. OUR JANUARY MEETING WAS HELD JANUARY 9TH . THANK YOU, DIRECTOR SNYDER, FOR GIVING US A TOWNSHIP UPDATE AND THANK YOU TO FIRE CHIEF BUCK WHO GAVE US TIPS FOR PROTECTING OUR PROPERTY. WE HAD SEVERAL VISITORS JOIN US IN THE MEETING AND WE HAVE NINE VILLAGE ASSOCIATION POSITIONS AND FIVE POSITIONS ON THE RD RC ON FEBRUARY 17TH. I WILL ATTEND THE ELECTION MEETING TOMORROW EVENING WHERE BALLOTS WILL BE COMPLETED. WE PARTICIPATED IN THE HOLIDAY LIGHTING CONTEST AND MADE AN AWARD OF THE BEST HOUSE 23 . BETHANY WON FOR BEST NEIGHBORHOOD. THE LIGHTS WERE AMAZING, THE RESIDENTS WERE IN THE HOLIDAY SPIRIT. MEMBERS OF THE BOARD MET IN DECEMBER FOR A HOLIDAY GET-TOGETHER AT YULI'S KITCHEN, ONE OF OUR SPONSORS, AND WE HAD A GREAT EVENING. OUR NEXT MEETING IS HELD TUESDAY, FEBRUARY 13TH AND THE BOARD MADE THE DECISION TO HOLD OUR ANNUAL MEETING IN MARCH, ON THE THIRD TUESDAY OF THE MONTH , SINCE SEVERAL FAMILIES HAVE PLANS FOR SPRING BREAK , SO OUR ANNUAL MEETING WILL BE TUESDAY, MARCH 19TH.

WE TYPICALLY MEET ON THE SECOND TUESDAY OF EACH MONTH , UNLESS WE CHANGE IT FOR A SITUATION , AND ALL RESIDENTS ARE INVITED AND ENCOURAGED TO ATTEND AND THAT INCLUDES MY REPORT.

>> THANK YOU FOR BEING HERE. THANK YOU. DIRECTOR FRANKS?

>> YES, NANCY IS DOWN WITH A BAD COLD AND DID NOT WANT TO SPREAD IT TO THE CROWD SO SHE ASKED ME TO MAKE A FEW COMMENTS ABOUT THE CHILI COOKOFF. SATURDAY, THEY HAD FABULOUS WEATHER, PROBABLY A RECORD-BREAKING CROWD . THE SNOW HILL WAS PARTICULARLY ATTRACT LIVE FOR ALL USE, AS WAS ONE OF OUR FIRE TRUCKS AND FIREFIGHTERS THAT NOT ONLY DEMONSTRATED THE TRUCK TO THEM BUT LET THEM TAKE PICTURES INSIDE , AND DRIVING THE TRUCK, ET CETERA. IT WAS A GREAT EVENT. PARKING WAS A PREMIUM IN ALL THE LOTS IN THE ROADWAY , SO ALL IN ALL, I THINK IT WAS THE BEST ONE THEY'VE EVER HAD.

THE FOOD WAS TERRIFIC AND A GOOD TIME WAS HAD BY ALL.

PERFECT WEATHER FOR IT. VERY GOOD EVENT.

>> THANK YOU . I CALL FOR EMOTION AND A SECOND TO RECEIVE

AND FILE THE REPORT. >> MOVED.

>> SECOND. >> ALL THOSE IN FAVOR, SIGNIFY

[ CONSENT AGENDA]

. A POST? MOTION PASSES. THAT BRINGS US TO THE CONSENT AGENDA WITH THE CONSENT AGENDA ITEMS ARE NONCONTROVERSIAL OR "HOUSEKEEPING" ITEMS REQUIRED BY LAW AND WILL BE CONSIDERED FOR APPROVAL AS A GROP WITH ONE MOTION. NO DISCUSSION WILL TAKE PLACE ON THESE ITEMS UNLESS THE ITEM IS REMOVED FROM THE CONSENT AGENDA AND PLACED ON THE REGULAR AGENDA BY ANY BOARD MEMBER PRIOR TO TAKING A VOTE ON THE MOTION. IS THERE A

MOTION -- >> SECOND.

>> IT HAS BEEN MOVED. AND SECONDED , ALL IN FAVOR,

[8. Receive, consider and act upon a quarterly update from the Development Standards Committee; ]

SIGNIFY BY SAYING AYE. ALL OPPOSED? MOTION PASSES. THAT BRINGS US OUR REGULAR AGENDA, THE FIRST IS A QUARTERLY UPDATE. WE WELCOME THE CHAIRMAN OF THE DEVELOPMENT STANDARDS COMMITTEE AND HE WILL PROVIDE US WITH AN UPDATE REGARDING ALL DSA MATTERS. WELCOME.

>> THANK YOU BUT IT'S A PLEASURE TO BE HERE TO GIVE YOU A REVIEW OF 2023 FOR THE DEVELOPMENT STANDARDS COMMITTEE. I WOULD LIKE TO START OFF WITH A SNAPSHOT OF OUR AGENDA ITEMS THAT WE WENT THROUGH TO GIVE YOU AN OVERVIEW OF THE KEY ITEMS WE DISCUSSED AND THEN GIVE YOU A PREVIEW OF THE FUTURE ITEMS WE ARE WORKING ON, NOW, AND WILL BE WORKING ON THROUGH 2024. WE DID A TOTAL OF 893 APPLICATIONS , AS YOU WOULD EXPECT, 70% WERE RESIDENTIAL.

IT WAS A LITTLE LESS THAN WHAT WE DID IN 2022, ROUGHLY 7% LESS . SOME OF THE MAJOR ITEMS THAT WE REVIEWED , WASTING MORE PEOPLE TRYING TO UPDATE THEIR BACKYARDS . WE HAD A LOT OF PEOPLE PRESENT APPLICATIONS FOR NEW FENCES . THAT IS

[00:25:01]

SOMETHING WE ARE WORKING ON, WHICH I WILL EXPLAIN LATER IN OUR WORKSHOP. WE ARE SEEING A LOT OF ROOM ADDITIONS, PARENTS MOVING IN , SO WE ARE SEEING A LOT OF ROOM ADDITIONS BUT WE ARE STILL SEEING THE REMODELING , AND OTHER AREAS, AS WELL.

WE ARE SEEING SOME OF THE LUXURY HOMES BEING TORN DOWN AND BEING REPLACED. THE REDEVELOPMENT CRAZE IS GOING ON , FROM A COMMERCIAL STANDPOINT, WE ARE SEEING IT REDEVELOPMENT STRUCTURE , LIGHTING CHANGES IN THE PARKING LOTS WITH NEW LIGHTING COMING OUT. WE ARE ALSO SEEING MONUMENT SIGNS BEING REPLACED. MOVING ON TO THE RECAP OF SOME OF THE KEY ITEMS, WE ONLY MADE THE PAPER TWICE LAST YEAR, WHICH IS PRETTY GOOD. WE HAD ONE ARTICLE IN THE COURIER ON SOLAR PANELS AND ONE IN THE VILLAGER ON PETS, BOTH WERE FAVORABLE. WE DID WORK WITH THE WOODLANDS FIRE DEPARTMENT ON SOLAR PANELS AND BATTERY PACKS, AND WE DID HAVE THOSE STANDARDS IN PLACE. WE DID FORGO SOME OF THE APPLICATION REQUIREMENTS FOR RESIDENCE ON A COUPLE INSTANCES THAT HAPPENED LAST YEAR, THE JUNE 21ST STORM THAT CAME IN , AND ALSO THE DROUGHT. WE RELINQUISH RESPONSE ABILITY TO GET APPROVAL BEFORE THEY STARTED . IT'S INTERESTING, AT OUR LAST MEETING, WE HAVE IMPLEMENTED ANOTHER DIRECTIVE THAT PEOPLE DON'T HAVE TO WORRY ABOUT THE STANDARD FOR THEIR LANDSCAPING RIGHT NOW UNTIL THEY ASCERTAIN WHETHER OR NOT THERE SHRUBS HAVE DIED AND EVERYTHING, SO WE WILL DO THAT.

ON THE DSC WORKSHOP ITEMS, WE DO HAVE A FENCE STANDARD WHERE WE HAD A JOINT COMMITTEE AND STAFF TO LOOK AT THE PRESENT FENCE STANDARDS WE HAVE RIGHT NOW AND HOW WE CAN UPDATE AND LIKE I SAID, WE ARE GETTING MORE PEOPLE THAT WANT TALLER FENCES FOR PRIVACY. WE ARE GETTING A SHIFT IN LAND , SO THAT THE STANDARD FENCE IS NOT WORKING. WE ARE ALSO GETTING MORE PEOPLE REQUESTING ARTIFICIAL FOLIAGE WITH THE WROUGHT IRON FENCES , AND THERE'S ARTIFICIAL FOLIAGE THAT YOU HAVE TO GO ALMOST AND TOUCH IT TO SEE THAT IT'S NOT REAL, SO WE ARE GETTING MORE AND MORE OF THAT. WE DID WORK WITH WOODLANDS WATER TO WORK ON LANDSCAPING SUSTAINABILITY , TO REDUCE THE USE OF WATER, AND WE DID ADOPT A NEW DEVELOPMENT STANDARDS COMMITTEE BY LAW WHICH IS ONLINE SO THAT ANY RESIDENT CAN LOOK AT THAT. WE DID HAVE SOME CONTROVERSIAL ITEMS , AS YOU WOULD EXPECT. WE HAD A COUPLE SHORT-TERM RENTALS THAT WE PULLED TWO PERMITS ON , THE FIRST TIME WE'VE EVER DONE THAT. AS YOU CAN IMAGINE, A LOT OF RESIDENCE SHOWED UP.

IT WAS INTERESTING THAT THE LAST ONE WE PULLED, THE RESIDENTS BLAMED US FOR ALLOWING SHORT-TERM RENTALS AND WE EXPLAINED THAT WE HAVE TO DO THAT, BY LAW. THAT WAS NOT KNOWN. I GUESS YOU COULD SAY THAT WAS A SHOCK. WE DID PULL TWO PERMITS . WE ALSO FOUND QUITE A FEW THAT CAME IN FRONT OF US, IT'S ALMOST NEIGHBOR TO NEIGHBOR AND WE GOT CAUGHT IN THE MIDDLE OF IT. THERE WAS A LOT OF PEOPLE THAT CAME IN WITH LEGAL REPRESENTATION, ALSO. WHAT WE ARE SEEING IS THAT YOU'LL HAVE A PERSON THAT WILL TRY TO DO SOME ADDITIONS TO THEIR HOME OR TRY TO CHANGE SOMETHING WITHIN STANDARDS AND SOMEONE IN THE NEIGHBORHOOD DOES NOT LIKE IT AND THEY WILL GET OTHER PEOPLE IN THE NEIGHBORHOOD TO ADD ON TO THEIR COMPLAINT AND THEN YOU GET A BUNCH OF PEOPLE IN THE MEETING AND IT'S A BACK-AND-FORTH, SO WE FOUND QUITE A BIT OF THAT. THAT CONTINUES TO HAPPEN AT ALMOST EVERY MEETING, IT SEEMS LIKE , AND WE GET CAUGHT IN THE MIDDLE OF A NEIGHBOR TO NEIGHBOR ISSUE. LIKE I MENTIONED, ONE OF THE BIG THINGS IN THE LAST YEAR WAS THE REMODELS AND THE REDEVELOPMENT , ALSO. SOME OF THE KEY ITEMS WE ARE WORKING ON RIGHT NOW, THE COMMITTEE DATA . THANK YOU FOR THAT REPORTING

[00:30:09]

. THAT IS A BIG HELP. I WAS RE-ELECTED AS CHAIRMAN, SO WE FEEL GOOD ABOUT THE GROUP WE HAVE RIGHT NOW. WE DO HAVE ONE MAJOR ISSUE THAT WE NEED YOUR HELP ON, AND THIS IS BECOMING A PROBLEM . IT'S PROBABLY NOT A PROFESSIONAL WAY TO PRESENT IT, BUT THE AUDIO SYSTEM WE HAVE IN THAT ROOM SUCKS, IT

REALLY DOES. >> I BELIEVE YOU MEET IN THE DSC ROOM, AND I THINK IT'S BEING REPLACED. WE DID APPROVE

FUNDING TO REPLACE THAT . >> THIS IS BEEN GOING ON FOR

MONTHS. >> I KNOW.

>> WE ASKED FOR HELP. MAKE YOU ARE RIGHT AND IT'S IN THE PROCESS OF BEING REPLACED. THERE ARE REASONS IT'S TAKING MONTHS. WE'VE HAD PROBLEMS WITH THE VENDOR AND THE INSTALLATION, BUT THOSE ARE BEING RESOLVED AND I BELIEVE WE WILL SEE RESOLUTION AND GET TO THE QUALITY WE WANT TO VERY

SOON. >> THANK YOU.

>> WE WOULD BE HAPPY TO GO BACK . I'VE OFFERED TO GET ON AMAZON . IT'S REALLY BAD. THE RESIDENTS CAN HEAR US, WE CAN HEAR THEM AND IT'S EMBARRASSING SOMETIMES.

>> NO, IT IS. >> LIKE WE SAID, IT'S BEEN

GOING ON FOR MONTHS. >> DIDN'T WE HAVE THIS PROBLEM LAST YEAR AT THE STRATEGIC PLANNING MEETING? THAT WAS OVER

A YEAR AGO. >> WE DIDN'T HAVE A SYSTEM THEN, SO SINCE THEN WE'VE INSTALLED IT. WILLIAM IS HERE IF YOU WANT TO GET TECHNICAL, BUT WE ARE AWARE OF THE ISSUES.

WILLIAM, I DID NOT SEE YOU. EXCUSE ME.

>> THAT'S NOT ON THE AGENDA.

>> WE WILL ADDRESS THAT. THANK YOU.

>> WE DO HAVE WORKSHOPS LINED UP , ONE IN EACH QUARTER. WE HAVE DSC JOINT MEETINGS SET UP, WE CONTINUE TO LOOK AT THE RESIDENTIAL STANDARD , ANY ONES THAT WE NEED TO CONSIDER ADOPTING DIFFERENTLY . THAT IS SOMETHING WE ARE WORKING ON.

FINALLY, I DON'T KNOW IF THE NEXT 50 YEARS IS THE RIGHT BULLET TO USE, BUT WITH THE UPCOMING ANNIVERSARY OF THE WOODLANDS TOWNSHIP AND THE ROLE THAT DEVELOPMENT STANDARDS HAVE PLAYED IN THE SUCCESS , IT'S A VERY GOOD DOCUMENT. I DON'T KNOW IF YOU READ IT, BUT I THINK THAT IT AMAZES ME EVERY TIME I LOOK AT IT , THE FORESIGHT THEY HAD WHEN THEY WROTE THAT. THAT IN MIND, IF YOU NOTICE THE LAST COUPLE OF YEARS, WE'VE FACED DRASTIC CHANGES BECAUSE WE DID NOT FOR SEE A LOT OF OF THIS. NONE OF US THOUGHT ABOUT REDEVELOPMENT AND OUR MEMBERS SITTING IN A MEETING WHERE WE HAD A FORUM AND I SAID, I DON'T THINK YOU THOUGHT ABOUT THIS 30 YEARS AGO, DID YOU? ON ALL THE REDEVELOPMENT THAT HAS TAKEN PLACE. WE NEVER THOUGHT OF PEOPLE PAINTING BRICK HOUSES .

WHOEVER THOUGHT ABOUT SOLAR PANELS AND BATTERY PACKS IN HOUSES? NOBODY EVER FORESAW THE SHORT-TERM RENTALS IN RESIDENTIAL AREAS, SO, WHAT WE ARE SEEING IS THAT THERE ARE CHANGES THAT TOOK PLACE IN THE STANDARDS AND WE NEED TO BE PREPARED, THAT THERE WILL BE CHANGES IN THE FUTURE, ALSO.

IF YOU GET ON AI AND LOOK AT THE FUTURE IN HOUSING AND THINGS, IT'S PRETTY SCARY WHEN YOU LOOK AT THE STANDARDS WE HAVE AND WHAT THE FUTURE LOOKS LIKE, OUT THERE. CHANGE IS GOING TO BE CONSTANT AND A LOT OF PEOPLE DON'T LIKE SOME OF THE CHANGES. IT'S JUST SOMETHING WE ARE GOING TO HAVE

TO LIVE WITH. >> THANK YOU. QUESTIONS ?

>> I HAD TWO. YOU MAY HAVE ADDRESSED IT, BUT I JUST WANT , YOU JUST SAID THE WORKLOAD IS GOING TO INCREASE, ESPECIALLY WITH OUR AGING COMMUNITY, REMODELING, AND COMMERCIAL.

THE FIRST THING I HAD, DO YOU FEEL LIKE YOU ARE ADEQUATELY EQUIPPED TO HANDLE AN INCREASE IN THE WORKLOAD, DO YOU HAVE ADEQUATE RESOURCES? TO HANDLE AN INCREASE IN WORKLOAD , AS

OUR COMMUNITY AGES? >> I THINK SO. I THINK WE DO.

[00:35:05]

I THINK THE STAFF DOES A GREAT JOB. IT'S AMAZING , IF YOU COME TO OUR MEETINGS, YOU CAN SEE THE WORK THEY DO TO PREPARE FOR THE MEETING. I THINK WE ARE PRETTY WELL COVERED, THERE.

THAT YOUR MEETINGS ARE VERY LONG AND MAYBE THAT'S JUST THE NATURE OF THEM AND MAYBE IT ALWAYS HAS BEEN THAT WAY, BUT I THOUGHT, IS THERE ANYTHING, AND HE TALKED ABOUT PUSHING ANYTHING DOWN TO THE DRC TO DECREASE YOUR WORKLOAD?

>> THAT'S ONE OF THE REASONS WE HAVE THE JOINT MEETING, SO WE CAN SHARE THOSE , AND WHAT CAN WE DO DIFFERENTLY, TO MAKE THEIR LIFE EASIER AND OUR LIVES EASIER. WHAT HAPPENS , THEY ARE AT ABOUT FOUR HOURS. SOMETIMES , LIKE I MENTIONED, WE GET AN ITEM THAT WILL COME IN THAT IS VERY CONTROVERSIAL AND SOMETIMES IT TAKES A LONG TIME TO GO THROUGH IT. WE HAVE TO GIVE THE RESIDENT THE OPPORTUNITY TO PRESENT THEIR SIDE OF THE STORY , BECAUSE A LOT OF TIMES THEY PUT A LOT OF WORK INTO WHAT THEY WANT TO DO WITH THEIR PROPERTY. WE DO ALLOW THE COURTESY OF SPENDING THE TIME OF LISTENING TO WHAT THEY WANT TO MAKE SURE THAT WE UNDERSTAND A LOT OF TIMES WE HAVE TO WORK OUT THINGS . I'VE USED THE EXAMPLE BEFORE, SOMEONE WILL COME OUT, SO THEY WANT TO PUT A 900 SQUARE FOOT OUTDOOR KITCHEN , WELL, YOU'RE NOT GOING TO HAVE IT, BUT MAYBE WE CAN FIND THAT THIRD RIGHT ANSWER. SOMETIMES IT DOES TAKE A WHILE TO GO THROUGH THIS AND THE COMMERCIAL PROPERTIES

SOMETIMES TAKE A WHILE. >> SURE.

>> WELL, YOU UNDERSTAND HOW TO LOOK AT THESE PROBLEMS IN A DIFFERENT WAY, AS WE TALK ABOUT THE NEXT 50 YEARS, IS THERE ANYTHING, INSTEAD OF DOING PIECEMEAL BY PIECEMEAL REACTIVE MEASURES, IS THERE ANYTHING THAT WE CAN DO, MADE THE JOINT TASK FORCE, THAT WE WORK TOGETHER AND DEVELOP STANDARDS? WHAT WOULD YOU RECOMMEND TO SOMEONE IN THE GAME, LOOKING AT HOW WE CAN MAYBE ADDRESS THAT? IT IS

CHANGING SO FAST. >> OH, IT IS.

>> YOU LOOK AT SOLAR ROOFS THAT THEY ARE CREATING, THAT LOOK LIKE SHINGLES BUT THEY ARE SOLAR. I MEAN, GREAT TECHNOLOGY, BUT WHAT DOES THAT LOOK LIKE IN REAL TIME?

>> THAT IS ONE OF THE THINGS WE ARE DOING IN THE WORKSHOPS. WE ARE TRYING TO THINK OUTSIDE OF THE BOX, AS FAR AS STARTIN TO LOOK AT , ARE THESE THINGS THAT WE SHOULD BE DEALING WITH, NOW, AND LIKE, WITH THE SHINGLES YOU ARE TALKING ABOUT, THE TECHNOLOGY CHANGING ALL OF A SUDDEN. ARE WE ABREAST OF WHAT IS HAPPENING? WE ARE TRYING TO ADDRESS THOSE THINGS , TRYING

TO THINK OUTSIDE THE BOX. >> ANY RESOURCES YOU NEED, LET US KNOW. YOU PLAY HUGE SUPPORTING ROLE IN OUR

COMMUNITY. THANK YOU. >> YOU MADE THE COMMENT ABOUT PULLING SEVERAL PERMITS. HOW DO YOU MONITOR THAT, ONCE YOU HAVE GIVEN A PERMIT, I WOULD ASSUME, PERHAPS, WAS AT THE SHORT-TERM RENTAL OR SOMETHING LIKE THAT? HOW DO YOU MONITOR

THAT? >> SIX MONTHS. I CAN ASSURE YOU THE NEIGHBORS WILL LET US KNOW IF ANYTHING IS GOING ON.

THE MAC WAS MONITORED BY THE NEIGHBORHOOD.

>> YES, BUT BELIEVE ME , THEY ARE PROBABLY THE BEST WE HAVE OUT THERE. THEY WILL LET YOU KNOW IF ANYTHING IS HAPPENING.

MEETING? AND PRESENT THEIR GRIEVANCES, OR DO THEY HAVE AN ONLINE ACCESS TO THE MEETING TO GIVE YOU THEIR REPORTS ? WE HAVE THE 311 APP, WE GET REPORTS THROUGH 311.

>> THEY WILL COME TO THE MEETINGS OR THEY WILL CONTACT THE GOVERNANCE GROUP STAFF AND FILED A COMPLAINT IF THERE'S BEEN A PARTY GOING ON , A PARKING ISSUE. YOU KNOW, I THINK THAT WE DID A PRETTY GOOD JOB WHEN WE WROTE THE STANDARD.

IT'S FOUR PAGES LONG THAT THEY HAVE TO FOLLOW, AND THEY HAVE TO HAVE CONTACT NUMBERS , THEY HAVE TO HAVE SOMEONE

AVAILABLE 24 -- ALWAYS. >> THANK YOU.

>> OTHER QUESTIONS, COMMENTS? IF NOT, IS THERE A MOTION AND

SECOND TO RECEIVE THE REPORT? >> SO MOVED.

>> SECOND. ALL IN FAVOR, SIGNIFY BY SAYING AYE . ALL OPPOSED? MOTION PASSES. AS ALWAYS, THANK YOU . THAT

[9. Receive, consider, and act upon a 2023 Annual Report on Law Enforcement;]

BRINGS US TO OUR NEXT AGENDA TO ACT UPON A 2023 ANNUAL REPORT. THE SOUTH PATROL DIVISION PRESENT ON BEHALF OF

[00:40:12]

THEM, WITH PRECINCT 3. WE WOULD BE REMISS IF WE DID NOT RECOGNIZE AS ALWAYS, THE COUNTABLE'S OFFICE PRECINCT , WHO IS ALSO HERE, THIS EVENING AND ALSO, WITH US IS SERGEANT TARA WITH MONTGOMERY COUNTY PRECINCT THREE. IT IS YOURS.

PLEASURE TO BE HERE . I KNOW WITH THE RECENT CHANGE IN HARRIS COUNTY, WE'VE GOT A COMMISSIONER OF PRECINCT 3 AND THE CONSTABLE , THAT MADE IT A LITTLE BIT DICEY, SO THANK YOU FOR KEEPING THAT IN MIND. WE ARE HERE TO PRESENT TO YOU THE 2023 JOINT ANALYSIS REPORT FOR CALLS FOR SERVICE AND ACTIVITIES ACROSS THE WOODLANDS TOWNSHIP AND HARRIS COUNTY . WHAT YOU HAVE BEFORE YOU RIGHT NOW IS AGAIN, AND ANALYTICAL DATA OF CALLS FOR SERVICE AND THE MINIMUM RESPONDED TO OVER THE LAST 12 MONTHS. YOU KIND OF SEE THE EBB AND FLOW OF CALLS FOR SERVICE AND HOW THEY PICK UP DURING THE SUMMER, AND HOW THEY DROP OFF , USUALLY IN FEBRUARY.

PART OF THE REASON THEY DROP OFF IN FEBRUARY IS THE NUMBER OF DAYS IN THE MONTH, RIGHT? YOU HAVE THREE FEWER DAYS AND BELIEVE IT OR NOT, THAT HAS AN IMPACT ON CALLS FOR SERVICE.

WE ARE STILL ABLE TO MAINTAIN . YOU ARE GRACIOUS TO BOTH AGENCIES DURING THE BUDGET PROCESS, SO WE WILL BE ADDING ADDITIONAL PERSONNEL THAT WE BELIEVE WILL BE BENEFICIAL IN KEEPING OUR COMMUNITIES SAFE. A SUMMARY OF CRIMES IN THE CATEGORIES OF NOTES, AS MENTIONED BEFORE , THE DIRECTORS HAVE ALWAYS ASKED FOR A LIST OF CRIME CATEGORIES OR CALLS FOR REPORTS THAT EACH AGENCY TAKES AND WANTS TO KEEP TRACK OF. THIS IS A SUMMARY, MEANING IT'S A TOTAL OF THOSE REPORTS THAT WE'VE TAKEN OVER THE LAST 12 MONTHS , MONTH BY MONTH, NOTING THAT OCTOBER, WE HAD SOME SPIKES . I MET WITH MY TEAM, TODAY. WE TALKED ABOUT OUR SPIKES WE HAD AND HOW THEY ARE GOING TO USE INITIATIVES TO COMBAT THOSE, MOVING FORWARD. WE WILL TALK ABOUT THAT IN A LITTLE BIT. WHAT MAKES A CRIME CATEGORY OF NOTE? IT WAS DESIGNED BY THE DIRECTORS OF THE TOWNSHIP, AND SOME OF THOSE CALLS INCLUDE ASSAULT FAMILY VIOLENCE IS, ASSAULT EXCLUDING FAMILY VIOLENCE, BURGLARIES OF HABITATION, BURGLARIES OF MOTOR VEHICLE. CRIMINAL MISCHIEF, FRAUDS AND FORGERIES, HOMICIDES, ROBBERIES, SUICIDE AND ATTEMPTED SUICIDE, AUTO THEFT, OTHER TYPES OF THEFT , MISDEMEANOR AND FELONY, AND ALL OTHER CRIMINAL REPORT AND THEN INFORMATION REPORTS. ALL OF THOSE NUMBERS ARE COMPILED BACK TO YOUR CRIME CATEGORIES OF NOTE. A RUNAWAY CHILD WOULD BE CONSIDERED A NONCRIMINAL REPORT , BUT WE STILL TAKE IT, RIGHT? TWO NEIGHBORS THAT GET INTO A DISAGREEMENT. WE ARE GOING TO DOCUMENT THIS DISTURBANCE, BUT NO CRIME WAS COMMITTED , BUT IT WILL BE DOCUMENTED. THOSE GET LUMPED IN THERE. WHEN YOU START LOOKING AT NUMBERS, YOU HAVE TO LOOK AT REAL NUMBERS. WE TRY TO LOOK AT THINGS THAT WE CALL QUALITY-OF-LIFE CRIMES. THESE ARE THINGS WE BELIEVE THAT LAW ENFORCEMENT OFFICERS HAVE THE ABILITY TO IMPACT AND REDUCE THOSE QUALITY-OF-LIFE CRIMES , WHICH THEN GOES TO OUR STRATEGIC PLAN OF REDUCING CRIME AND THE FEAR OF CRIME. IF WE CAN REDUCE QUALITY-OF-LIFE CRIMES, YOU FEEL SAFER . WHEN WE ARE DEALING WITH THE RECENT SPIKE IN CADILLAC CONVERTER THEFTS, THOSE ARE QUALITY-OF-LIFE CRIMES. WE WANT TO IMPACT THOSE. BURGLARIES FROM HARRIS COUNTY, NO OFFENSE, COMING TO MONTGOMERY. WE HAVE TWO SOUTHERN BORDERS, ONE AT SPRING CREEK AND ONE AT THE RIO GRANDE, THAT END UP IMPACTING OUR COMMUNITIES , SO WE TRY TO PUSH THEM TO THE SERGEANT AND HE TRIES TO PUSH THEM BACK. WE MOVED BACK AND FORTH THOSE ARE REAL ISSUES THAT LAW ENFORCEMENT HAS TO DEAL WITH.

WHEN I HAVE BEFORE YOU IS JUST A MAP ON ACCIDENTS, BECAUSE CRASHES AND THE IMPACT OF MOBILITY IN THIS COMMUNITY , TRULY IS A CONCERN . ANYTIME YOU HAVE LOVED ONES ON THE STREET , AND THEY ARE INVOLVED IN AN ACCIDENT, IT MATTERS. IF

[00:45:05]

THERE ARE THINGS WE CAN DO IN THE LAW ENFORCEMENT ARENA TO MAKE OUR ROADWAYS SAFER BY REMOVING IMPAIRED DRIVERS, REDUCING THE SPEED OF VEHICLES AS THEY APPROACH INTERSECTIONS , BY ENFORCING THE INTEGRITY OF STOP AND GO SIGNALS, RED MEANS STOP, NOT USE THREE CARS GO THROUGH. WHEN WE LOOKED AT 2023, WHAT WE SAW IS A 9% REDUCTION IN CRASHES OVER 2022. THAT'S A REALLY GOOD STEP IN THE RIGHT DIRECTION. WE STILL HAD 1117 CRASHES IN HARRIS AND MONTGOMERY COUNTIES.

YOU HAVE ON YOUR MAP WHERE THOSE ACCIDENTS ARE. WE HAD TWO FATALITY CRASHES, BOTH OF WHICH OCCURRED ON COLLEGE PARK DRIVE. THEY WERE ACCIDENTS. SOMEONE DIDN'T GET UP THAT MORNING INTENDING FOR SOMEONE TO LOSE THEIR LIFE, BUT AS A RESULT OF FAILURE TO FOLLOW SAFETY LAWS , IT RESULTED IN THE DEATH OF TWO INDIVIDUALS. WE HAD 257 INJURY ACCIDENT .

THAT WAS STILL DOWN FROM LAST YEAR, BUT ONLY DOWN A 2% MARGIN. THE TOP FIVE ACCIDENT CONTRIBUTED FACTORS INCLUDES SPEED, OUR NUMBER ONE ISSUE. WHY? BECAUSE WE ARE ALWAYS IN A HURRY. OUR SOCIETY IS AN IMMEDIATE GRATIFICATION SOCIETY. WE WANT IT NOW, I DON'T WANT TO WAIT FOR IT. A LOT OF PEOPLE'S DRIVING HABITS ARE ALONG THE SAME LINES. THEY ARE TRYING TO GET TO WHERE THEY ARE GOING, FAILING TO YIELD THE RIGHT-OF-WAY. WHEN THE YELLOW FLASHING LIGHTS FIRST CAME ABOUT, WE STARTED HAVING A NUMBER OF CONCERNS. A LOT OF PEOPLE GOT ACCUSTOMED , NOW, TO THOSE LIGHTS, BUT WE STILL HAVE A NUMBER OF CRASHES THAT RESULT FROM SOMEONE TURNING LEFT ON A FLASHING YELLOW LIGHT , NOT YIELDING THE RIGHT-OF-WAY, REALIZING THE OTHER OPPOSING TRAFFIC STILL HAS THE RIGHT-OF-WAY. CHANGING LANES , WHEN UNSAFE, I'M SURE YOU'RE NOT SHOCKED, DRIVER DISTRACTIONS , UTILIZING CELL PHONES IN THE CARS IS STILL A CONCERN . IMPAIRED DRIVING , WE STILL ARE WORKING ON REDUCING THE NUMBER OF PEOPLE WHO ARE OPERATING MOTOR VEHICLES UNDER THE INFLUENCE OF DRUGS OR ALCOHOL IN THOSE THINGS DO MAKE OUR ROADWAYS LESS SAFE.

THAT'S PRETTY MUCH A SUMMARY ON ACCIDENTS. IT'S THAT TIME OF YEAR, WHERE FRAUDS AND SCAMS ARE HAPPENING AND HAPPENED A LOT. PEOPLE RECEIVE EMAILS , SAYING ANYTHING FROM, YOU HAVE A WARRANT FOR YOUR ARREST BUT IF YOU BUY ME AN APPLE GIFT CARD IT WILL GO AWAY, DO YOU DIDN'T SHOW UP FOR JURY DUTY, WE ARE COMING AFTER YOU, BUT IF YOU PUT MONEY IN MY BITCOIN ACCOUNT , TO THE ONE CIRCULATED IN EARLY JANUARY , WHICH IS I HAVE HACKED INTO YOUR COMPUTER, I NOW HAVE ACCESS TO YOUR CAMERA AND I SAW WHAT YOU DID. IF YOU DON'T SPEND MONEY, I WILL TELL EVERYONE WHAT I SAW. THE PROBLEM IS, THIS IS A BUCKSHOT APPROACH WHERE THEY SEND THIS EMAIL TO HUNDREDS OF THOUSANDS OF PEOPLE HOPING SOMEBODY MIGHT PAY $1200 TO KEEP IT FROM GOING PUBLIC. IF THIS EVER HAPPENS, WE ENCOURAGE PEOPLE, NUMBER ONE, TO SECURE YOUR PASSWORDS. IF YOU ARE NOT CHANGING YOUR PASSWORDS EVERY YEAR, DO SO. IF YOU ARE USING THE SAME PASSWORD ACROSS MULTIPLE DIFFERENT LOGINS, THAT THE PROBLEM AND YOU NEED TO FIND A BETTER WAY . WHAT HAPPENS IS, IF YOU HAVE A DATA BREACH OF THIS COMPANY, AND THAT'S THE SAME PASSWORD AND SAME EMAIL ADDRESS AND IT GETS SOLD ON THE DARK WEB, NOW THEY HAVE ACCESS TO ALL YOUR BANKING INFORMATION. IF YOU DON'T USE TWO FACTOR AUTHENTICATION, WHERE THEY HAVE TO SEND YOU A SIX DIGIT CODE TO YOUR CELL PHONE OR A NUMBER, SO YOU CAN FURTHER SECURE YOUR LOGIN, CONSIDER DOING THAT. I SHARE THOSE THINGS WITH YOU . THE EMAIL EXTORTION CONTINUES . IT HAS TONED DOWN, JUST A LITTLE BIT, BUT A LOT OF IT HAS TO DO WITH DATING SITES AND OTHER SITES WHERE PEOPLE GET TO KNOW SOMEBODY AND THEY GET BEFRIENDED ON A DIFFERENT TYPE OF SOCIAL MEDIA, AND BEFORE LONG THE CONVERSATION GOES TO SEND PICTURES, AND ONCE PICTURES ARE SENT, THE THREATS COME THAT IF YOU DON'T PAY MONEY, YOUR PICTURE WILL BE SENT TO ALL YOUR FRIENDS. LASTLY, I WILL SUMMARIZE, WHEN TALKING ABOUT SOME THINGS, I KNOW THIS BOARD IS GOING TO BE TAKING ACTION LATER ON, BUT I JUST WANT TO TELL YOU THAT THE

[00:50:03]

ISSUES OF SOLICITATION AND PEOPLE SETTING UP HOMELESS CAMPS IN DIFFERENT AREAS HAS CONTINUED TO BE A CONCERN .

RESIDENTS WILL CONTACT DIRECTORS, DIRECTORS CONTACT ME, DEPUTIES GO OUT. THE NUMBER ONE CONCERN WE HAVE WITH PUBLIC SAFETY IS , IS THAT PERSON AWARE OF RESOURCES AVAILABLE ALREADY THROUGH NONGOVERNMENT ORGANIZATIONS . WE TRY TO PAIR THEM UP. HAVING A WAY TO STREAMLINE THAT AND HAVE A PUSH CARD , FOR LACK OF A BETTER TERM, THAT ALLOWS HIM TO HAVE THE INFORMATION IS A GREAT IDEA. I THINK YOU ARE REALLY ON THE RIGHT APPROACH TO SERVING A COMMUNITY, NOT JUST TRYING TO CRIMINALIZE SOMEONE BEING DOWN ON THEIR LUCK. WE ALSO NEED TO MAKE SURE THAT THEY ARE NOT BEING FORCED TO BE OUT THERE, THE ENDING IN THOSE CORNERS. ANYWAY, ARE THERE ANY

QUESTIONS WE CAN ANSWER? >> I DO HAVE ONE. I APPLAUD THAT WE , THE CRIME APPEARS TO BE REDUCED AND ALSO APPLAUD THAT WE ARE ONE OF THE SAFEST COMMUNITIES IN THE COUNTRY .

AND THANKFUL TO MONTGOMERY COUNTY SHERIFF'S OFFICE, MONTGOMERY COUNTY CONSTABLE, AND OF COURSE, HARRIS COUNTY CONSTABLE'S OFFICE. JUST RECENTLY, I RECEIVED A NUMBER OF EMAILS ABOUT INDIVIDUALS BREAKING INTO HOMES. I THINK THAT WE, AS RESIDENTS, I VERY MUCH WANT US TO BE AWARE THAT EVEN THOUGH WE MAY THINK WE ARE THE SAFEST, THAT CRIME STILL CAN OCCUR. SATURDAY NIGHT, JANUARY THE SIXTH, AT 8:14, FIVE INDIVIDUALS CAME ACROSS THE PALMER GOLF COURSE AND JUMPED OVER THE FENCE INTO OUR BACKYARD. I WAS HOME ALONE, WATCHING THE HOUSTON TEXAS FOOTBALL GAME IN THE MASTER BEDROOM ON THE FIRST FLOOR. I DID NOT HAVE THE ALARM SET , AS IT WAS EARLY IN THE EVENING AND I HAVE LIVED IN THIS HOUSE FOR 20 YEARS WITHOUT INCIDENT. AT 8:16, LATER CONFIRMED BY MY CAMERA FOOTAGE, THREE OF THE INDIVIDUALS CLIMBED UP THE BACK OF MY HOUSE ONTO A SECOND STORY BALCONY THAT FACES THE GOLF COURSE. I HEARD NOISES AS THEY LANDED ON THE BALCONY . I DID NOT HAVE MY HEARING AIDS IN AND COULD NOT DISCERN WHAT OR WHERE THE NOISES COMING FROM. EXITING MY BEDROOM, AND WALKING TO THE LIVING ROOM, I HEARD A LARGE CRASH, LOOKED UP, AND SAW THE MAN BREAKING INTO MY HOME. I WENT BACK INTO MY BEDROOM, RETRIEVED A GUN FROM A GUN SAFE IN A SECURE CLOSET AND CALLED 911. I WAS ON THE PHONE WITH THE 911 OPERATOR AND THE TWO OTHER MEN SHATTERED MY BEDROOM WINDOW , LESS THAN SIX FEET AWAY FROM WHERE I WAS STANDING. I FIRED A SHOT WITH MY SHOTGUN THROUGH THE DRAPERY AT THE WINDOW. THE 911 OPERATOR WAS AWARE OF WHAT WAS HAPPENING AND TOLD ME TO STAY SAFE AND THAT THE SHERIFF'S OFFICE HAD ALREADY DISPATCHED OFFICERS TO MY HOME. THE MEN JUMPED DOWN FROM THE BALCONY AND ALL FIVE FLED ACROSS THE PALMER GOLF COURSE. THE MONTGOMERY COUNTY SHERIFF'S DEPARTMENT WAS ON THE SCENE WITHIN LESS THAN SIX MINUTES. SEVERAL OFFICERS ARRIVED AT MY HOUSE WITH THEIR PATROL DOG, AND TRACKED THE INTRUDERS ALMOST THREE FOURTHS OF A MILE FROM MY HOME, ACROSS THE GOLF COURSE. THEY WERE IN ANOTHER NEIGHBORHOOD , TO A CAR PARKED ON AN EMPTY CUL-DE-SAC.

MONTGOMERY COUNTY SHERIFF'S OFFICERS WERE OUTSTANDING.

THEY SECURED MY HOME AND ASSISTED ME, THEY LOCKED DOWN SEVERAL ADJACENT NEIGHBORHOODS IN SEARCH FOR THE BURGLARS.

THEY ALSO DID A GREAT JOB COLLECTING EVIDENCE , TOOK DNA, FOUND THE GLASS BREAKAGE TOOL AND A CELL PHONE NEAR OFFENSE.

AFTER SECURING A SEARCH WARRANT, THE MONTGOMERY COUNTY SHERIFF'S DEPARTMENT TOLD THIS INFORMATION THAT I THINK YOU WILL ADDRESS. ONE, AS SAFE AS WE ARE, CRIME STILL HAPPENS, AND I SHARED WITH CAPTAIN HOLLIFIELD BEFORE THIS EVENING THAT I WAS GOING TO READ THIS , BUT IN THE LAST

WEEK, I'VE HAD FOUR. >> FOR PEOPLE?

>> FOUR DIFFERENT PEOPLE WHO HAVE ADDRESSED THIS , AND I WOULD LIKE , CAPTAIN, TO KNOW THAT , AND YOU SAID IT BEFORE.

PEOPLE ARE MOVING UP AND I WANT PEOPLE TO BE AWARE THAT YOU NEED TO TURN ON YOUR ALARM. THE INDIVIDUAL WHO SENT IT, ASKED ME TO READ THIS, IT'S FROM RALPH MACK AND BILL. HE SAID

YOU MAY ADDRESS IT. >> SURE. THANK YOU. THERE ARE

[00:55:06]

SOME COMPONENTS TO THE INVESTIGATION THAT , DUE TO THE COMPLEXITY OF IT, I AM NOT GOING TO BE ABLE TO SHARE WITH YOU. I WILL SAY THIS, THAT OUR HOME CRIMES UNIT RESPONDED, AS WELL AS OUR CRIME SCENE INVESTIGATORS AND THE K9 UNIT.

SHERIFF HENDERSON WANTED THE FULL FORCE OF THE AGENCY TO MAKE SURE WE SEND A CLEAR MESSAGE TO THOSE WHO WANT TO TAKE ADVANTAGE OF THIS COMMUNITY, AND WE DO THAT BY HOLDING PEOPLE ACCOUNTABLE. IN THEIR HASTE TO GET AWAY, AND PERHAPS THE PELLETS FIRED FROM THE SHOTGUN, AND AVOIDING THE DETECTION OF THE DOGS, THEY DROPPED HIS CELL PHONE , WHICH IS A TREMENDOUS ASSET TO AN INVESTIGATOR WHEN SOMEONE LEAVES BEHIND BREADCRUMBS . THAT TELLS YOU WHERE THEY HAVE BEEN, COOL THEIR CONTACTS ARE AND PERHAPS, TEXT MESSAGES THEY'VE HAD. IN ORDER TO GET INTO THAT CELL PHONE, WE HAVE TO GET SEARCH WARRANTS THAT REQUIRE COURT ORDERS AND WE HAVE TO ACTUALLY FIND A WAY TO BYPASS SECURITY MEASURES ON PHONES, WHICH ARE NOT ALWAYS EASY. I THINK YOU MAY HAVE SEEN RECENT CASES WHERE APPLE DOES NOT WANT TO SHARE WITH LAW ENFORCEMENT THOSE TOOLS THAT WE DESPERATELY NEED. IT'S IMPORTANT THAT WE ARE ABLE TO DO THAT. THEY HAVE SUSPECTS AND THEY ARE WORKING ON THOSE, BUT THAT'S ALL I CAN TELL YOU BECAUSE IT COULD BE RELATED TO OTHER CASES AND WE WOULD NOT

WANT TO COMPROMISE THOSE. >> THE COMMENT WAS MADE TWO FOLD, 12 APPLAUD THE QUICK RESPONSE , BUT TWO, TO LET US KNOW THAT WE NEED TO TURN ON OUR ALARMS, TURN ON THE LIGHTS, AND BE AWARE THAT THAT CAN HAPPEN DID

>> SURE. WHILE WE DO HAVE A SAFE COMMUNITY , IN PART BECAUSE OF YOUR GENEROUS SUPPORT IN PUBLIC SAFETY, SHERIFF HENDERSON'S LEADERSHIP, AND OUR ABILITY TO HAVE MEN AND WOMEN WHO ABSOLUTELY WANT TO STAND IN THE GAP , NOT JUST MONDAY THROUGH FRIDAY, BUT EVERY DAY, MAKING SURE YOUR HOME, PROPERTY, AND FAMILY, ARE SAFE, WE DO HAVE A CRIMINAL ELEMENT THAT DOES NOT JUST LIVE HERE , THAT WILL COME UP HERE AND WILL STILL YOUR PROPERTY , THAT WILL TAKE THINGS OUT OF YOUR GARAGE IF YOU DO NOT LOCK IT, THAT WILL TRY TO TAKE ADVANTAGE OF YOUR PURSE, IF YOU LEAVE IT IN PLAIN SIGHT, WILL FOLLOW YOU FROM THE BANK , WHILE YOU ARE INSIDE THE STORE, WILL TRY TO BREAK INTO YOUR CAR AND TAKE THE CASH YOU JUST RETRIEVED FROM THE BANK. WHAT ARE SOME SAFE THINGS WE ASK RESIDENTS TO DO? WORK WITH NEIGHBORHOOD SERVICES . WE HAVE A GREAT DEPARTMENT THAT WINS AWARDS EVERY YEAR FOR NATIONAL NIGHT OUT, WHICH THE WHOLE KEY PREMISE BEHIND THAT IS GETTING TO KNOW YOUR NEIGHBORS . WE TALKED EARLIER ABOUT THE NEIGHBORS WHO WILL LET YOU KNOW , ABSOLUTELY NEIGHBORS WILL LET YOU KNOW. IF YOU DON'T KNOW WHO YOUR NEIGHBORS ARE, THEY DON'T KNOW WHO YOU ARE AND THEY DON'T KNOW WHAT'S NORMAL. WE ENCOURAGE RESIDENTS TO GET TO KNOW YOUR NEIGHBORS, LOOK OUT FOR ONE ANOTHER . WHILE YOU SUPPORT US WITH PROVIDING 100 OFFICERS HERE, THINK ABOUT HOW MANY OFFICERS MIGHT BE ON THE STREET ON ANY GIVEN OUR AT 3:00 IN THE MORNING. RIGHT? BECAUSE THEY HAVE TRAINING, THEY HAVE ARRESTS, THEY MAY BE AT THE JAIL, THEY MIGHT BE ON ANOTHER CALL. WE HAVE TO LOOK OUT FOR ONE ANOTHER. WE CAN'T EXPECT THE SHERIFF'S OFFICE OF THE CONSTABLE'S OFFICE OR ANY OTHER AGENCY TO BE ABLE TO STAND IN THE GAP ALL THE TIME.

WE HAVE TO TAKE SOME OWNERSHIP OF OUR OWN PERSONAL SAFETY AND THAT INCLUDES UTILIZING DOOR LOCKS, MAKING SURE WE HAVE LIGHTS, AND IN THIS CASE, THEY DID BREAK IN, THEY DID USE FORCE. MANY TIMES THE CASES WE GET WERE PROPERTY IS STOLEN, THE GARAGE WAS NOT CURED, THE CAR WAS LEFT UNLOCKED , THE PURSE WAS LEFT IN THE CAR, THE WALLET WAS LEFT IN THE CAR, THE CELL PHONE WAS LEFT IN THE CAR, AND THOSE ARE DIFFICULT FOR US.

RIGHT NOW, THERE'S A RASH OF TARGETED THEFTS . SO, I WILL TELL YOU THIS TIDBIT. IF YOU HAVE A CAR THAT YOU THINK MIGHT BE THE LATEST CRAZE OF AUTO THEFT, TAKE AND GET YOU AN AIR TAG AND BURY IT IN ONE OF THE HEADREST . WHAT HAPPENS IS, WHEN THESE CRIMINALS TAKE A CAR , LAW ENFORCEMENT CAN START TRACKING THE AIR TAG BECAUSE THEY WILL HAVE A PHONE WITH THEM, RIGHT? WE DON'T HAVE THIS TECHNOLOGY AVAILABLE AND WE NEED THE COMMUNITY TO HELP US PROTECT THEM , RECOVER THEIR PROPERTY, KEEP THEIR PROPERTY FROM BEING STOLEN, AND IF EVERY TIME SOMEONE STEALS A CAR THEY GO TO JAIL IN MONTGOMERY COUNTY, WHICH MEANS WILL BE HERE A WHILE AND THEY GET HELD ACCOUNTABLE BY OUR JUDGES AND JURIES, WHICH MEANS IT'S NOT LIKE IT IS WITH OUR FRIENDS TO THE SOUTH WHERE IT MIGHT BE A REVOLVING DOOR THE JAIL , I THINK IT'S A LITTLE BIT OF A

[01:00:02]

DIFFERENT SCENARIO. WE ARREST PEOPLE WHO ARE OUT ON BOND FOR ZERO DOLLARS OUT OF HARRIS COUNTY COMMITTING CRIMES IN MONTGOMERY COUNTY ALMOST ON A WEEKLY BASIS.

>> I LIKE WHAT YOU SAID ABOUT THE AIR TAG. I DIDN'T THINK OF THAT. THAT'S A COMMUNICATIONS OPPORTUNITY RIGHT THERE , TO GET ON SOCIAL MEDIA . THAT'S A GREAT IDEA. I DO HAVE A QUESTION. I AM IN THE LEADERSHIP CLASS , AND I GOT TO TOUR THE JAIL , THE REAL-TIME CRIME CENTER, THAT THE SHERIFFS SET UP . IT'S INCREDIBLE. I DON'T WANT TO GO INTO IT ALL, BUT IF YOU COULD JUST BRIEFLY TELLS ABOUT IT, I WANT THIS BOARD TO LISTEN TO HOW WE CAN WORK TOGETHER WITH BUSINESSES, HOTELS, AND COMMERCIAL AREAS TO USE THIS AS A RESOURCE. THIS IS A GREAT WAY TO FIGHT CRIME , RIGHT HERE, RIGHT NOW.

>> GO ON. >> ONE OF THE THINGS THAT SHERIFF HENDERSON DID AFTER TAKING OFFICE WAS TO ESTABLISH A REAL-TIME CRIME CENTER. THIS UTILIZES SOCIAL MEDIA AND ALL AVAILABLE TOOLS TO FEED INFORMATION TO THE MEN AND WOMEN RESPONDING TO CALLS FOR SERVICE. WE MAY GET A CALL AND THE CALL IS BASED ON THE INFORMATION THE CALLER TOLD THE DISPATCHER, THE DISPATCHER TOLD THE DEPUTY. MANY TIMES, HIS UNDERLYING INFORMATION THAT VERY HELPFUL . WHAT HAPPENS IS THE REAL-TIME CRIME CENTER ENGAGES AND IMMEDIATELY ESTABLISH COMMUNICATION WITH THE OFFICER AND THEY START DOING BACKGROUND INFORMATION , AND THEY ARE ABLE TO FEED THE RESPONDING OFFICERS INFORMATION ABOUT SUSPECTS, SUSPECT VEHICLES, THAT MANY TIMES, SHORTENS THE TIME AN INVESTIGATION TAKES AND INCREASES THE LIKELIHOOD OF TAKING SOMEONE INTO CUSTODY. NOW, THE GUARDIAN PROGRAM WE HAVE , AND I WILL LET THE CAPTAIN, I DON'T WANT TO TAKE HIS THUNDER, HIS TEAM HAS A GUARDIAN PROGRAM BECAUSE WHEN YOU GO IN THERE, IF THE WALL OF CAMERAS AND IT ALMOST LOOKS LIKE ESPN OR DISNEY , THEY HAVE THESE CAMERAS AND IF THERE IS A CRIME GOING ON , THEY ARE ABLE TO IMMEDIATELY TAP IN TO THOSE CAMERAS IN THAT GENERAL REGION AND USE IT. RIGHT NOW, WE USE INTERSECTION CAMERAS. WE HAVE ACCESS TO THOSE. THEY DON'T RECORD, BUT WE HAVE ACCESS TO REAL-TIME TRACKING IF WE ARE LOOKING FOR A CERTAIN VEHICLE WE CAN THROW A BROAD NET AND THAT REALLY HELPS TO IMPACT OUR LIKELIHOOD OF TAKING SOMEONE INTO CUSTODY AND HOLDING THEM ACCOUNTABLE. AS YOU START LOOKING AT THINGS AND VARIOUS DEVELOPMENTS, ESPECIALLY IN TOWN CENTER, MAYBE IT WOULD BE A GREAT IDEA TO SEE IF WE COULD NOT INCLUDE THAT IN THE PROGRAM SO THAT IT HELPS US KEEP THIS COMMUNITY SAFER, ESPECIALLY -- IN

TOURISM AREAS. >> THANK YOU. UNLESS WE HAVE MORE QUESTIONS, THANK YOU , AS ALWAYS.

>> OKAY, DIRECTORS. THIS IS THE FOURTH QUARTER STATISTIC REPORT . I HAVEN'T SEEN YOU SINCE LAST YEAR, GOOD TO SEE YOU. ALL RIGHT. YOU HAVE FUNDED THREE ADDITIONAL AREAS AT THE END OF LAST YEAR, ONE WENT TO SAFE HARBOR SPECIAL VICTIMS UNIT AND IN THE THIRD QUARTER WE HAD 27 NEW CASES ASSIGNED TO THOSE DETECTIVES, 26 ALREADY OPEN AND IN THAT QUARTER, WE HAD THREE FELONY CHARGES FILED. AS A REMINDER, SAFE HARBOR HANDLES SEXUAL ASSAULT, CHILD ABUSE , INDECENCY WITH A CHILD , THOSE REPORTS . WE HAVE THREE DETECTIVES AND I'VE NOTICED AS WE'VE ADOPTED THIS, THESE ARE BEING PROCESSED MORE EFFICIENTLY AND QUICKLY . WE ARE GOING TO GET THROUGH THOSE CASES MORE QUICKLY AND THEN DETECTIVES CAN GO OUT TOGETHER TO WORK ON THEM, SO IT REALLY HELPS IN THAT PROCESS. OKAY.

SO, WE HAVE SIX NEW CASES ASSIGNED FOR LAST QUARTER FOR ICAC. YOU HAVE FIVE SEARCH WARRANT OPERATIONS, AND THAT'S NOT TOTAL SEARCH WARRANTS. SEARCH WARRANT OPERATIONS IS WHERE WE WENT WITH A TACTICAL TEAM WITH RIFLES AND HELMETS AND KNOCKED ON SOMEONE'S DOOR, TOOK THEM DOWN IF WE HAD TO, AND MADE AN ARREST, AND EXECUTED A SEARCH WARRANT OF THE PROPERTY, ANY ELECTRONICS THAT MIGHT HAVE CHILD PORNOGRAPHY. WE FILED 10 FELONY CHARGES IN THAT PERIOD OF TIME, WITH ONE MISDEMEANOR CHARGED . WE DON'T USUALLY FILE THOSE , AND ICAC , IT WAS AN APARTMENT MANAGER THAT WERE

[01:05:06]

THE PERSON, SO WE RESTED HER FOR DOING THAT BECAUSE WE WORKED WITH HER TO KNOW WHERE HE LIVED , OR WHERE THE SUSPECT LIVED, SORRY. SAFE HARBOR, 2023 , FOURTH QUARTER , SO WE SAW A SLIGHT UPTICK IN TOTAL CASES ASSIGNED , 117 LAST YEAR AS OPPOSED TO ONE 112 IN 2022. SO THAT'S FIVE MORE CASES. WE EXPECT IT TO CONTINUE TO RISE. IT'S NOT A DRAMATIC INCREASE , BUT IS AN INCREASE NONETHELESS AND WE APPRECIATE THE ADDITIONAL RESOURCES. ICAC, 2023 FOURTH QUARTER VERSUS 20 22, TOTAL CASES INCREASED . I THINK FOR SEARCH WARRANTS, THEY PUT RESIDENT SEARCH WARRANT , I THINK THE ORANGE NUMBER IS WHAT THEY DID NOT INCLUDE, THE FACT THAT THESE ARE SEARCH WARRANTS. WE DO SEARCH WARRANTS ON ELECTRONIC DEVICES, COMPUTERS, THINGS LIKE THAT, SOCIAL MEDIA. SAY I NEED A SEARCH WARRANT FOR FACEBOOK OR INSTAGRAM, THAT'S A SEARCH WARRANT. THEY INCLUDE RESIDENTIAL SEARCH WARRANTS FOR SOMEONE'S HOMES. ALL OF THAT INCREASES IN 2023 AS OPPOSED TO 2022. WE HAVE A VERY PROACTIVE ICAC DETECTIVE AND SHE IS DOING VERY GOOD WORK. NOTABLE UPDATE , FROM DECEMBER, A MALE DEFENDANT RIDE IT -- RESIDING IN ORION, TEXAS SHARED CHILD SEXUAL ASSAULT MATERIAL WITH AND ICAC DETECTIVE. A SEARCH WARRANT WAS EXECUTED AND MULTIPLE DEVICES WERE RECOVERED CONTAINING CHILD SEXUAL ABUSE MATERIAL, OR CHILD PORNOGRAPHY. HE WAS ARRESTED AND CHARGED IN MONTGOMERY COUNTY AN INVESTIGATION SHOULD HE DOWNLOADED AND SHARED OVER 22,000 PIECES OF MEDIA CONTAINING CHILD SEXUAL ABUSE MATERIAL . IF YOU CAN IMAGINE THE WORST POSSIBLE THING IN THE WORLD, THAT WHAT THEY DO. IF YOU CAN IMAGINE IT EXISTS, IT EXISTS, AND PROBABLY WORSE.

KEEP THAT IN MIND. SO, WE'VE GOT TWO HUMAN TRAFFICKING DETECTIVES THAT STARTED IN NOVEMBER. THEY'VE BEEN GOING TO TRAINED PROGRAMS TO TAKE CERTIFICATIONS FOR THE ASSIGNMENT AND THE PRIMARY OBJECTIVE IS CHILD TRAFFICKING.

AS WITH ICAC INVESTIGATIONS, THE FOCUS EFFORT IN WOODLAND AND MONTGOMERY COUNTY AND WE EXPECT SOME OF THE INVESTIGATIONS WILL LEAD TO OTHER JURISDICTIONS AS WELL AND OUR GOAL IS TO FILE CHARGES THEY JUST SO YOU KNOW, THESE DETECTIVES ARE VERY PROACTIVE AND VERY GOOD AT WHAT THEY DO.

THEY WILL BE MAINLY FOCUSED ON LEARNING . THEY WILL BE ONLINE , CHATTING, POSING AS A 13-YEAR-OLD OR 14-YEAR-OLD AND SAYING HEY, YOU KNOW. ARE YOU INTERESTED , AND IF THEY GET SOLICITED, THEY COME TO THE WOODLANDS TOWNSHIP AND THEN WE ARREST THEM. THAT IS WHAT THEY ARE DOING. NOT THE MOST GLAMOROUS JOB IN THE WORLD. AS OF TODAY, WE HAVE TWO HUMAN TRAFFICKING DETECTIVES PARTICIPATING IN THE MULTIAGENCY OPERATION WITH THE INTENTION OF LURING PEDOPHILES WITH THAT OPERATION BEGAN TODAY , JANUARY 24TH. WE HOPE TO SOON REPORTS THAT IT'S BEEN SUCCESSFUL IN ARRESTING MULTIPLE SUSPECTS WHO DECIDED TO COME HERE FOR THAT REASON.

YOU PROVIDED US THREE ADDITIONAL DETECTIVES FROM THIS LAST BUDGET AND IT IS MAKING A DIFFERENCE AND WE APPRECIATE THAT. IF INCREASED MY WORKLOAD QUITE A BIT AS SERGEANT, BUT WE ARE MAKING MORE OF AN IMPACT IN THE

COMMUNITY THAN EVER. >> WE APPRECIATE EVERYTHING YOU

DO. >> THANK YOU FOR THE GOOD

WORK. >> ANY QUESTIONS? THANK YOU.

SEE YOU SOON. >> IS VERY MOTION AND A SECOND

TO ACCEPT THE REPORT? >> SECOND. ALL IN FAVOR,

SIGNIFY BY SAYING AYE . >> AYE.

[10. Receive, consider and act upon the financial report;]

>> ALL OPPOSED? MOTION PASSES. THAT BRINGS US TO AGENDA ITEM 10 . CONGRATULATIONS, ON BEHALF OF THE BOARD.

[01:10:06]

PRESENT THE NOVEMBER 2023 FINANCIALS , THIS EVENING. THE FIRST SLIDE IS REVENUES, THE YEAR TO DATE BUDGETED REVENUES IS 150.7 MILLION . THE YEAR-TO-DATE COLLECTED IS $128.5 MILLION . FOR YEAR TO DATE, $12.8 MILLION. THE MAIN COMPONENT OF THE FAVORABLE VARIANT IS DUE TO HIGHER THAN BUDGETED TAX COLLECTIONS AND HIGHER THAN BUDGETED INTEREST REVENUE , PROGRAM REVENUE, AND GRANT REVENUE. NEXT WE HAVE EXPENDITURES THROUGH NOVEMBER , ONE OR 2.3 , FOUR $377,137 .

SEVERAL OF THE DEPARTMENTS THROUGHOUT THE YEAR HAVE HAD OPEN POSITIONS AND THIS HAS CONTRIBUTED TO THE FAVORABLE VARIANT AS WELL AS CONTRACTED SERVICES COMING IN LOWER THAN ORIGINALLY BUDGETED. THESE ARE OFFSET BY UNSCHEDULED OVERTIME DEPLOYMENT EXPENDITURES FOR THE FIRE DEPARTMENT, WHICH IS OFFSET WOULD GRANT REVENUE BECAUSE WE ARE REIMBURSED FOR THOSE EXPENDITURES AND WE HAD STORM CLEANUP EXPENDITURES AND HIGHER THAN BUDGETED EVENT ADMISSION SALES TAX PAYMENTS THAT ARE ALSO OFFSET REVENUE. THE NEXT SLIDE IS HOTEL OCCUPANCY TAX DEPOSITS AND THIS IS THROUGH DECEMBER 31ST. THE YEAR TO DATE BUDGETED IS 8.9 MILLION. THE YEAR-TO-DATE ACTUAL COLLECT IT IS 9.6 MILLION. FOR A FAVORABLE VARIANT OF A LITTLE UNDER 716,000. WHEN COMPARING THAT TO THE SAME TIME , ALL 12 MONTHS OF 2022, THAT'S A LITTLE OVER $1 MILLION MORE COLLECT DID IN '23. NEXT WE HAVE SALES TAX DEPOSIT. THE YEAR TO DATE BUDGETED IS $66.66 MILLION. COLLECTED WAS $72.2 MILLION. WHEN COMPARED TO THE SAME TIME IN 2022, IT'S A LITTLE OVER $5 MILLION

. QUESTIONS OR COMMENTS? >> GOOD NEWS. QUESTIONS, COMMENTS , FOR OUR CHIEF FINANCIAL OFFICER? THE MAC I ADDED ONE MORE SLIDE FOR YOU. WE DID GET JANUARY. IT WAS $170,600, WHICH IS 23,000 AND CHANGE OVER BUDGET. ALL THE FUN PEOPLE HAD A GOOD TIME IN NOVEMBER.

>> DR. SHELLEY SEKULA-GIBBS. >> THANK YOU. CFO SHAW, COULD YOU GO BACK TO THE SALES TAX SLIDE? THE ONLY SURPRISE I SAW WHEN I WAS REVIEWING YOUR WORK , NOT YOUR WORK, BUT THE TEAMS WORK, IS THE DECEMBER ACTUAL.

>> OKAY. SO IN DECEMBER, WE COLLECTED ABOUT $196,000 LESS THAN BUDGETED . WE ARE WAITING ON THE COMPTROLLER REPORT FOR THE AREA REPORTS TO SEE EXACTLY WHERE THE CHANGE WAS FROM THE PRIOR YEAR. WE'VE GOTTEN A REPORT THAT WAS INACCURATE, SO WE HAVE REQUESTED IT AGAIN AND AGAIN , BUT I CAN TELL YOU , OVERALL, AS FAR AS ON THE STATE LEVEL, THERE WAS A SLIGHT INCREASE IN SALES TAX AND IT WAS MAINLY IN MANUFACTURING AND SERVICE, WHICH INCLUDES LIVE ENTERTAINMENT AND RESTAURANTS .

I KNOW THAT DOESN'T HELP YOU MUCH WITH YOUR QUESTION, BUT WE WILL BE ABLE TO SEE WHEN WE DO GET THAT DECEMBER, WHERE WE WERE LAGGING IN THE PRIOR YEAR, FROM WHAT WE HAD ANTICIPATED.

NEXT TIME. >> I WILL. WE HAVE NOT GOTTEN JANUARY'S, EITHER, SO HOPEFULLY WE WILL GET THE TWO TOGETHER AND I CAN BRING IT BACK NEXT MONTH.

>> THANK YOU. >> IS THERE A MOTION TO ACCEPT

THE FINANCIAL? >> I WOULD LIKE TO SAY SOMETHING. JUST TO PUT , UNMIXED BEVERAGE TAXES, $170,000 OVER 24% HIGHER THAN BUDGETED , IF YOU LOOK AT

[01:15:01]

THAT, COMPARATIVELY TO HOW WE ARE STACKED AGAINST OTHER MUNICIPALITIES OF SIMILAR SIZES, WE ARE TWICE GREATER THAN SUGARLAND IN MIXED BEVERAGE TAXES, 2.5 TIMES HIGHER THAN SOUTHLAKE,, TEXAS, 1.5 TIMES ROUND ROCK, AND TWO TIMES HIGHER THAN MCKINNEY. THE MAC WE HAVE A DRINKING PROBLEM.

>> WHAT DOES THAT SAY? THE MAC KNOW, BUT THIS IS ALSO NOT DURING THE PAVILION TIME. NOVEMBER IS NOT WHEN YOU HAVE A LOT OF PAVILION SHOWS. I THINK YOU'LL SEE THE TREND OF THIS FOLLOW TOURISM WHEN WE HAVE SALES TAXES AND THINGS GO UP AND A LOT OF VISITORS, SO THAT'S A GREAT THING. I ALSO THINK THAT IT'S IMPORTANT TO POINT OUT THAT ALL OF THESE TAXES ARE BEING CHARGED ON PEOPLE WHEN THEY CAME HERE, THEY ARE ALL GOING TO THE STATE. IT'S NOT UNTIL SENATOR CRAYTON AND REPRESENTATIVE TOTH HELPED US TO PASS A BILL THAT GOT US TO KEEP OUR FAIR SHARE AND I THINK THIS IS A GREAT

THING FOR US TO LOOK INTO. >> TO PIGGYBACK ON THAT, BECAUSE OUR HOTEL TAX IS JUST ONE MONTH LAG, I THINK THAT WOULD BE AN INDICATOR FOR THE MIXED BEVERAGE. I FEEL LIKE THOSE KIND OF COMPARE THE SAME.

>> GREAT. THANK YOU. >> TERRIFIC REPORT.

>> MOTION? >> MOTION TO ACCEPT.

>> SECOND. >> IT HAS BEEN MOVED AND SECONDED. ALL IN FAVOR, SIGNIFY BY SAYING AYE.

[11. Receive, consider and act upon an interim solution for The Woodlands Community Magazine; ]

>> AYE. >> ALL OPPOSED? MOTION PASSES.

THANK YOU. THAT BRINGS US TO AGENDA ITEM 11 . I REFER YOU TO PAGES 44 AND 45. DIRECTOR OF COMMUNICATION , MS. PETERSON, WILL PROVIDE INFORMATION RELATED TO AN INTERIM SOLUTION FOR THE WOODLANDS TOWNSHIP COMMUNITY MAGAZINE.

>> YOU DO HAVE THE AGENDA ITEM AND I WOULD LIKE TO SAY THANK YOU FOR PREPARING AND READING IT . REALLY, I'D LIKE TO TAKE ANY QUESTIONS YOU HAVE AT THIS TIME. I WILL SAY THAT SINCE THE INCEPTION OF THE MAGAZINE, THERE HAS NEVER BEEN A MISSED ISSUE FROM HARVEY, COVID, NEVER.

>> WHAT'S THE REASON FOR THE POTENTIAL MISSED ISSUE NOW?

>> THE PUBLISHER PULLED OUT. >> OKAY.

>> I WILL SPEAK TO THAT. I WORKED A LITTLE BIT ON THIS AND TALKED TO YOU, LEANNE. ONE IS, I WAS SHOCKED WITH THE CUSTOMER, RESIDENT POLLS OF HOW IMPORTANT THIS PUBLICATION IS. I REALLY WAS SHOCKED. THERE'S OBVIOUSLY A LOT OF PEOPLE READING AND I THINK IT'S A GREAT RESOURCE, ESPECIALLY WITH THE SERVICES WE OFFER THROUGH PARKS AND POOLS AND ARBOR DAY AND THE LIKE. I THINK IT'S IMPORTANT . MY CONCERN IS IF YOU AND YOUR TEAM CAN HANDLE IT AND WHEN YOU CAME TO US WITH YOUR BUDGET THE FIRST TIME, THIS IS NOT INCLUDED. AS SOMEONE THAT WORKS IN MARKETING AND COMMUNICATIONS, THIS IS A LOT MORE CONTENT PUT ON YOU AND YOUR TEAM. HOW ARE YOU GOING TO TAKE THAT ON AND DO WE NEED TO

DO A BUDGET AMENDMENT? >> SO, THAT IS CORRECT. THIS IS ONE ISSUE WE ARE TALKING ABOUT FOR THE DESIGN AND LAYOUT . WE HAVE A VERY TALENTED STAFF THAT HAS THE ABILITY TO DO THE DESIGN AND LAYOUT IN-HOUSE . WE WILL JUST SHIFT RESPONSIBILITIE S AROUND TO MAKE SURE THAT HAPPENS AND WE HAD ALREADY PREPARED A JANUARY ISSUE , WHENEVER WE GOT THE WORD THE PUBLISHER WAS NO LONGER GOING TO BE ABLE TO DO THE MAGAZINE.

WE WERE ALREADY PREPARING FOR IT AND HAVE A GOOD TEMPLATE IN

PLACE FOR THE MARCH ISSUE. >> GREAT.

>> WHAT IS YOUR PREFERENCE? >> REALLY, THIS IS A DECISION THAT'S UP TO THE BOARD. IT'S NOT A BUDGETED ITEM, SO THE AMOUNT IS FOR THE POSTAGE AND THE PRINTING WHICH IS VERY COSTLY, WHICH IS WHY I GAVE YOU THREE DIFFERENT OPTIONS TO CHOOSE FROM, BUT I DO BELIEVE PRINT IS A VERY IMPORTANT WAY TO REACH THE COMMUNITY THAT IS NOT ONLINE.

>> HELP ME UNDERSTAND , AND I APOLOGIZE , BECAUSE I DIDN'T GET THE NUMBERS DOWN, WHAT IS THE COST ? IF WE WERE TO DO THAT IN-HOUSE, OURSELVES, YOU ARE LOOKING AT 40,000?

>> YES, FOR THE PRINTING . THE COST OF THE PRINTING AND THE

COST OF THE POSTAGE. >> OKAY.

>> WE ARE STILL GOING TO PRODUCE THE MAGAZINE IN-HOUSE REGARDLESS OF YOUR DECISION TONIGHT, BUT IN ORDER TO PRINT IT AND DISTRIBUTE IT TO THE HOUSEHOLDS OF THE WOODLANDS TOWNSHIP, WE NEED A BUDGET AMENDMENT.

>> I'M OF THE OPINION, WE NEVER MISSED AN EPISODE, I DON'T WANT TO MISS ONE NOW FOR $40,000 .

>> IS THAT EMOTION? >> IT IS.

>> I WILL TAKE A SECOND. >> MOVED AND SECONDED. FURTHER

[01:20:04]

DISCUSSION? >> I HAVE A QUESTION. YOU PROBABLY COVERED THIS DID OBVIOUSLY, THERE WERE ADVERTISEMENTS IN THE PREVIOUS ISSUES AND THAT'S WHY THE PUBLISHER , I WOULD THINK, CAME OUT IN A FAVORABLE WAY.

OBVIOUSLY THEY WERE NOT IN BUSINESS TO LOSE MONEY. DO YOU KNOW, IS THAT THE PROCESS THAT WILL CONTINUE, A SELLING OF ADS, OR DO WE NEED TO CHANGE THAT GOING FORWARD?

>> WE HAVE SUGGESTED IN THE RFP THAT THE VENDORS COME BACK WITH A PROPOSAL THAT WOULD INCLUDE ADVERTISEMENTS OR SPONSORSHIPS TO OFFSET THE COST OF PRINTING AND POSTAGE .

THAT SAID, WE DO NOT BELIEVE IT IS SUSTAINABLE, THAT IT WOULD BE ZERO DOLLARS TO THE TOWNSHIP, THAT THE TOWNSHIP WOULD HAVE TO PAY FOR A PORTION OF THAT BUT WE ARE LOOKING TO OFFSET THOSE COSTS WITH THE CONTINUATION OF ADVERTISING

AND SPONSORSHIPS. >> AND YOU DON'T HAVE AN IDEA

YET ON THE RATIO ? >> WE DO NOT HAVE THAT, YET.

THE RFP WAS ISSUED EARLIER THIS MONTH. THEY ARE DUE BACK FRIDAY , SO WE WILL BE REVIEWING THAT AND HOPE TO GET

THAT BACK TO YOU IN FEBRUARY. >> OKAY, THANK YOU.

>> OTHERS ? IF NOT, MOVED AND SECONDED .

>> EXCUSE ME, I'M SORRY. I JUST WANT TO ASK , IN MARCH, WHAT CRITICAL INFORMATION COMES OUT IN THAT ISSUE?

>> IN THE MARCH ISSUE, WE ARE TALKING ABOUT EVENTS UPCOMING, OF COURSE IN MARCH . THERE ARE ART EVENTS COMING UP AND IN ADDITION, WE DO HAVE A CAMPAIGN GOING ON WITH OUR NEIGHBORHOOD SERVICES CALLED SAID IT, DON'T FORGET IT, THAT DEALS WITH THE ALARMS AND THE ISSUES YOU JUST SPOKE ABOUT EARLIER TONIGHT , AND THEN I WOULD HAVE TO GET BACK WITH YOU ON ALL THE

CONTENT . >> IT SOUNDS LIKE IT'S PRETTY

CONTENT RICH, THOUGH. >> IS THIS WHERE THEY TALK ABOUT THE DIFFERENT SWIM CLASSES AND ALL OF THAT, IN THE

MARCH ISSUE? >> THAT'S ACTUALLY THE ACTION GUIDE, WHERE WE DETAIL ALL OF THE CLASSES AND PROGRAMS OFFERED IN THE SPRING AND SUMMER AND THEN FALL AND WINTER. IT'S A DIFFERENT PUBLICATION.

>> OTHER QUESTIONS OR COMMENTS? IF NOT, IT'S BEEN MOVED AND SECONDED. TO PRINT A 16 PAGE PUBLICATION AND MAIL IT TO 35 RESIDENTIAL PROPERTIES IN AN AMOUNT NOT TO EXCEED $40,000 TO THE BUDGET AMENDMENT TO THE 2024 COMMUNICATIONS BUDGET.

ALL IN FAVOR, SIGNIFY BY SAYING AYE.

[12. Receive, consider and act upon an award of bid for reforestation tree install services (C-2023-0323) and authorize the purchase of tree stock (C-2022-0215); ]

THANK YOU. THAT BRINGS US TO AGENDA ITEM 12 , TO RECEIVE , CONSIDER, AND ACT UPON THE BOARD FOR REFORESTATION SERVICES AND AUTHORIZE THE PURCHASE OF TREE STOCK. OUR CHIEF OPERATING OFFICER WILL PROVIDE INFORMATION RELATED TO AN AWARD BID FOR REFORESTATION, TREE INSTALL SERVICES, AND TREE STOCK OPTIONS.

>> SURE, THANK YOU. I WANT TO STEP BACK AND REALLY IDENTIFY HOW WE GOT HERE , NOT FROM THE DECISION OF HIS BOARD, TO CONTINUE THE PLAN, BUT HOW DID THE REFORESTATION PLAN GET IDENTIFIED AND STARTED BID FOR THE PAST, SINCE 1999, THE COMMUNITY HAS WORKED WITH AN INTEGRATED FOREST MANAGEMENT PLAN WHICH WAS APPROVED BY THE COMMUNITY ASSOCIATION'S BOARD IN 2002 OR 2003. DUE TO THE DROUGHT YEARS OF 2009, 2010, 2011, 2012, THE BOARD ACTUALLY INDICATED A REVIEW OF INTEGRATED FOREST MANAGEMENT PLAN AND RECONFIRMED A LOT OF THINGS THAT WE HAD BEE DOING OVER THE COURSE OF THE TIME, WHICH INCLUDED VARIOUS REFORESTATION STOCK TYPES, SIZE TYPES, AS WELL AS EDUCATION AND SO ON. THAT IS THE CRITICAL BIBLE THAT WE USE OF HOW WE MANAGE THE COMMUNITIES FOREST . OVER THE COURSE OF THE YEARS, ESPECIALLY SINCE THE 2013 REVISION TO THE FOREST MANAGEMENT PLAN, THERE HAS BEEN A HEAVY EMPHASIS ON REFORESTATION AND COMMUNITY FOR STATION. FOR MANY YEARS, THE COMMUNITY HAS BEEN PLANTING 3000+ LARGER STOCK TREES OF THE 15 TO 30 GALLON SIZE AND MISCELLANEOUS SIZES, ESPECIALLY THE SEEDLINGS YOU SEE THAT WILL BE GIVEN OUT, THIS WEEKEND , AT ARBOR DAY. THE BOARD CHALLENGED US, AS STAFF, TO IDENTIFY WAYS TO PLANT 6000 TREES DUE TO THE CYCLES WE'VE HAD IN THE LAST COUPLE YEARS AS WELL AS ADDITIONAL DROUGHT. BIDS WERE PUT OUT. WE RECEIVED THREE BIDS FOR INSTALLATION . THE LOWEST BID WAS FROM ROSCOE

[01:25:04]

, WHICH WE WORKED WITH FOR A NUMBER OF YEARS ON PLANTING AND DIFFERENT PROJECTS THROUGHOUT THE COMMUNITY. THE STOCK PRICE WAS ALREADY APPROVED THE CONTRACT INSPECTION AND WHAT WE ARE LEARNING IS THIS OPTION .

THERE IS INFORMATION ABOUT THE SIZE OF TREES AND THE DIFFERENCE BETWEEN A 15 GALLANTRY , A FEW FEET WIDE AS WELL AS TALL. EACH TREE WE USE WE TRY TO IDENTIFY WHERE WE ARE GOING TO PLACE IT, AND THERE ARE A NUMBER OF PLACES WE ARE LOOKING AT . THEY COULD BE ON THE PATHWAYS, THE RIGHT OF WAYS, THE PARKS, WITH THE OPEN SPACE RESERVES AND OTHER REFORESTATION EFFORTS WE HAD . WE HAVE 6000 TREES AT $1.41 MILLION WHICH IS ABOVE THE BUDGETED AMOUNT, SO TRY TO BE CREATIVE , WITH 6000 TREES, JUST UNDER $1 MILLION AS WELL AS THE TOTAL COST , $947,000 . THE OTHER FACTOR WE WANT TO PROVIDE IS WHEN WE TRY TO DEVELOP THIS OPTION, WE THOUGHT IT WAS A GOOD BALANCE OF SIZE OF TREE SIZES AND PROVIDES ADDITIONAL DOLLARS BECAUSE THROUGHOUT THE YEAR, WE GET REFORESTATION REMOVAL REQUEST . IT'S NOT UNCOMMON , WHERE WE GET ON A WEEKLY BASIS, THOSE REQUESTS, TOO MUCH SOUND FROM THE ROAD, THEY FOUND , WE TRY TO LOOK AT THOSE AREAS AND SEE IF IT'S SUITABLE FOR PLANTING ADDITIONAL TREES AND WE LOAD THAT UP IN THE LIST. THIS YEAR, WE TRY NEW THINGS WITH REFORESTATION TO LEARN FROM CHALLENGES WE MAY HAVE HAD OVER THE COURSE OF THE LAST FEW YEARS. WE HAVE MODIFIED HOW WE DO ADDITIONAL WATERING TO THE TREES, WE HAVE MODIFIED THE SOIL OPERATION WE ARE DOING. WE ARE ACTUALLY ADDING , I DON'T KNOW IF THE RIGHT TERM IS SILICA, TO THE GROUND, WHICH ABSORBS WATER AND RELEASES WATER DURING THE DROUGHT, SO IT'S A CONSTANT EVOLUTION OF THE PROGRAM. WE ARE LOOKING AT TWO PLANTING PHASES, ONE IN MARCH, THROUGH EARLY APRIL, AND TAKING A HIATUS IN THE SUMMER BECAUSE THERE IS NO REGULAR WATER . WE TRY TO SUPPLEMENT THE WATER, BUT THERE'S ONLY SO MANY PEOPLE YOU CAN PUT ON THIS PROJECT . WE ARE PLANTING TREES OVER A 44 SQUARE MILE PROPERTY , SO IT'S NOT JUST RIGHT IN MY FRONT YARD. WE WILL BEGIN OUR FALL PLANTING IN LATE OCTOBER, ONCE THE WEATHER BREAKS INTO THE DECEMBER CYCLE. THE RECOMMENDATION IS THE BOARD IS DETERMINING THESE OPTIONS AND THEN WILL PURCHASE THE TEXT ENTRY DEPOT, AND THEN HAVE THE BID OF INSTALL.

>> OKAY, THANK YOU. ARE THERE QUESTIONS?

>> I HAVE A QUESTION. HOW DO YOU CHOOSE , IF WE ARE PICKING A NUMBER , 6000, HOW DO YOU CHOOSE WHERE TO PUT THESE TREES? NO OFFENSE, BUT I DON'T WANT ANYONE SAYING I DIDN'T GET MY FAIR SHARE OF TREES. DO YOU EVENLY DIVIDE

THEM AMONGST THE VILLAGES? >> WE HAVE 1000+ TREES IDENTIFIED AS A RESULT OF RESIDENT REQUEST. WE HAVE ANOTHER 200 OR 300 DUE TO CUL-DE-SAC REQUEST. WE HAVE VINE MATERIALS, AND THAT'S REALLY A KEY COMPONENT WHICH IS THE INVASIVE VINE. ONCE WE TEAR DOWN THOSE LINES, SOMETIMES THEY ARE SO INTENSIVE , THAT LEAVE A BARREN SPACE, I'VE BEEN USING THIS TERM, WE PUT THE REFORESTATION MATERIALS IN THERE TO JUMPSTART THE FOREST AGAIN. WE ARE PUTTING IN THOSE TREES, THERE'S 800 AND 900 THERE, WE LOOK AT SUPPORTING OUR PATHWAYS ALONG THE RIGHT OF WAYS , ESPECIALLY WHEN YOU START TO GET INTO , WE PLANTED IN CREEKSIDE PARK , WHERE AS WE START MOVING OUT OF CREEKSIDE PARK WEST , WHERE THE TREES REALLY ARE NOT THERE, IT'S BECAUSE OF HOW THE LAND WAS EVEN BEFORE THE DEVELOPER WAS THERE. WE ARE ADDING MORE TREES BECAUSE EVERYBODY LIKES THE SHADED PATHWAYS, IT'S A COOL EXPERIENCE . THAT'S SOMETHING WE'VE BEEN PUSHING

[01:30:05]

BUT THOSE TREES ARE ALREADY SPREAD OUT. WE HAVE A NUMBER OF THINGS OF JUST STREETSCAPES AND MEDIANS. WE'VE TALKED, OFTEN ON, ABOUT HOW TO BE CLOSE UP SOME OF THE GAPS IN THE MEDIANS THROUGHOUT THE COMMUNITY AND ALSO, LOOKING AT SPECIAL PROJECTS , TRACE CREEK PARK GOT HAMMERED THIS YEAR WITH THAT , I'M CALLING IT A MINI TORNADO, BUT THERE WERE MANY TREES THAT WERE DOWNED. I THINK LAST MONTH, WE TALKED ABOUT , MAYBE IT WAS AT THE VILLAGE MEETING, SOMETHING ABOUT CONCERNS FOR TRACE CREEK PARK. WE ARE TAKING A LOT OF INPUT AND A LOT OF CREDIT GOES TO JOHN MCGOWAN , MITCH HALL, OUR ASSISTANT DIRECTOR , OF JUST TAKING ALL THE INFORMATION, LOADING IT UP, KEEPING TRACK OF THAT, TO DEVELOP A REFORESTATION PLAN PRESENTED BASICALLY IN NUMBERS, BUT EQUITABLY DISTRIBUTED THROUGHOUT THE

COMMUNITY. >> IF WE COULD, GO AHEAD, WORKS TO THE VILLAGE PRESIDENTS ASSOCIATIO TO TOUCH BASE ON WHERE AND WHAT AND HOW, THAT WOULD BE GOOD. SECONDLY, I DRIVE DOWN TO FOUR TO A LOT. -- 242. A LOT. IT DOESN'T LOOK LIKE LAKE WOODLANDS. I DON'T KNOW IF WE COULD, , YOU KNOW, TO FILL IN THOSE GAPS. I ENCOURAGE US TO LOOK AT THAT AS AN OPTION OF HOW WE CAN PUT BUFFERS IN BETWEEN THERE.

>> THEN NEEDS TO BE CHANGES TO THAT.

>> LET ME GIVE YOU AN UPDATE ON THAT. 242 IS A STATE PROJECT VERSUS WOODLANDS PARKWAY BEING A COUNTY ROAD. DIFFERENT STANDARDS ARE IN PLAY, THERE. THERE WILL BE, THROUGH THIS, A CENTER MEDIAN. THERE WILL BE MORE LANDSCAPE AND THE BOARD HAS APPROVED THE LANDSCAPE ARCHITECTURE DOLLARS FOR THAT AND THAT WILL START IN A FEW MONTHS, I GUESS. WE ARE THROUGH THE 1448 PLANNING AND WE HAVE ANOTHER OPPORTUNITY TO HELP REFORESTATION AS WE WERE AWARDED THE GRANT FOR THAT PATHWAY . WE ALSO THINK THERE NEEDS TO BE SOME REFORESTATION IN THOSE AREAS, AS WELL. THAT'S NOT THIS YEAR, BUT IT'S DEFINITELY ON OUR RADAR FOR 2025 TO 2026 AND BEYOND.

>> I KNOW YOU DO A GREAT JOB, PLANTING 6000 TREES IS NO EASY

TASK. THANK YOU. >> YOU ARE ON TOP OF IT.

>> ANY OTHER QUESTIONS? >> I DO. THANK YOU. COULD YOU ALLUDE TO, OR REFRESH YOUR MEMORY ON HOW MUCH MONEY WAS ALLOCATED FOR THE 242 TXDOT PROJECT , SO THAT RESIDENTS CAN HEAR THAT ? BECAUSE IT IS ON AN ONGOING QUESTION. ARE THEY EVER GOING TO SEE THE RESULTS, JUST LIKE DIRECTOR BAILEY SAID, CAN YOU TELL US THE NUMBER ALLOCATED?

>> WHICH PROJECT? >> THE LANDSCAPING ON 242.

>> WE ARE ONLY PROVIDING THE LANDSCAPE ARCHITECTURE SERVICE.

WE ARE NOT PROVIDING THE COST OF ALL THE LANDSCAPE MATERIALS.

TXDOT IS BEARING THAT. I WANT TO SAY THE ENGINEERING , IT'S ABOUT HUNDRED THOUSAND DOLLARS IN THAT NEIGHBORHOOD. I DON'T HAVE THE EXACT AMOUNT. WE ARE WORKING WITH HALF THROUGH THEIR

ENGINEERING TASK FORCE. >> SO 100,000 FOR PLANNING.

WHAT ABOUT THE WATER? DEREK BAILEY ALLUDED TO THE FACT THAT THOSE HAVE WITHERED INTO NOTHINGNESS , SO WE HAVE TO BRING WATER ON AN ONGOING BASIS.

>> PREVIOUS TO THIS, THOSE TREES DID NOT HAVE WATER.

THAT WAS DONE BY NATURE. THE ADDITIONAL LANDSCAPING WE ARE TALKING ABOUT THROUGH TXDOT AS PART OF THE LANDSCAPE DESIGN WITH IRRIGATION DESIGN , SIMILAR TO WHAT OTHER MEDIANS HAVE IN THE COMMUNITY TO SUPPORT THAT.

>> WHO WILL PAY FOR THAT? >> WE WILL.

>> SO THAT'S NOT BUDGETED, YET.

>> THAT'S IN '25, '26. IT'S SIMILAR TO THE AGREEMENTS WE HAVE FOR THE WIRE WE PAY FOR FOR THE NEIGHBORHOOD ENTRANCES, THE MEDIAN TIPS ON WOODLANDS PARKWAY, AND SO ON.

>> OKAY, THANK YOU. >> DO YOU AND YOUR TEAM HAVE A RECOMMENDATION AMONGST THE OPTIONS YOU PRESENTED?

>> WE ARE LOOKING AT OPTIONS SEE. WE THINK IT GIVES THE GREATEST FLEXIBILITY IN THE NUMBER OF TREES AND GIVES

[01:35:03]

FLEXIBILITY THAT WE POTENTIALLY DON'T HAVE TO COME BACK IF WE ARE GETTING MORE ADDITIONAL REQUEST .

>> OKAY. >> IS VERY MOTION?

>> SO MOVED. >> DIRECTOR FRANKS. SECOND?

>> WE ARE MOVING. >> I DON'T THINK IT WAS NAMED THAT WAY. WE NEED TO MAKE THE MOTION.

>> MOVED TO ACCEPT . >> IT HAS BEEN MOVED AND SECONDED. OTHER QUESTIONS? IF NOT, ALL IN FAVOR, SIGNIFY BY SAYING AYE. ALL OPPOSED?? MOTION PASSES. THANK YOU. WE

WILL NOW RECESSED THE REGULAR MEETING OF THE BOARD. IT IS 7:36 , TO CONDUCT A PUBLIC HEARING RELATED TO TOWNSHIP

[14. PUBLIC HEARING: Convene and conduct a Public Hearing regarding proposed amendments to Township Order No. 020-09, related to the Pool and Park Fees;]

PARK, THE PUBLIC HEARING WILL CONVENE , AND YOU CAN REFER TO PAGES 49 TO 59 IN YOUR BOARD PACKET ON THE PROPOSED AMENDMENTS TO THE TOWNSHIP , 02009 AS RELATED TO PARK AND PARK FEES. I CALL THE NAMES FOR PUBLIC HEARING AND THERE WERE NONE WHO ARE SIGNED UP. NOR WERE THERE ANY HANDOUTS FROM THE PUBLIC. OUR PUBLIC COMMENT IS CONCLUDED AND I CALL ON DR. CHRIS, CHIEF OPERATING OFFICER, TO PRESENT.

PRESENTED BY THE DIRECTOR OF PARKS AND RECREATION LAST WEEK AND I'M FILLING IN FOR HIM THIS WEEK. THE POOL SCHEDULE WAS PRESENTED , I WILL NOT GO OVER THAT BECAUSE THAT'S NOT REALLY GERMANE TO THE CHANCE OF ORDER. THIS TOWNSHIP ORDER REALLY COVERS THE PARKS AND RECREATION FEE STRUCTURES AND THAT HAS TO BE APPROVED THROUGH A PUBLIC HEARING PROCESS AND WE ARE RECOMMENDING A HANDFUL OF CHANGES FOR THIS YEAR, THE TEAM REGULARLY REVIEWS THE FEES AND STRUCTURES ESPECIALLY FOR ITEMS THAT INCUR COST AND THOSE ITEMS THAT INCUR COST ARE POOL RENTALS, ADDITIONAL LIFEGUARDS, AND SO ON. THERE IS A RECOMMENDATION FOR A NEW TRC AND TID, ESTABLISHING A FEE OF $750 AND $950 , THE HIGHER FEES FOR NONRESIDENTS, AND A NEW FEE FOR ROB FLEMING AQUATICS CENTER . ADDITIONALLY, THERE IS A LAP LANE ON A CONTRACTED BASIS FROM SEVEN DOLLARS TO 825 AND ONE LAST FEE, WE MODELED A NUMBER OF TREE HOUSES AND SOME HAVE AIR-CONDITIONING NOW SO WE WANT TO DIFFERENTIATE THAT PRICE AND THOSE ARE WELL LOVED AND USED . THOSE FEES ARE BEING RECOMMENDED TO YOU, THE BOARD

[15. Reconvene the regular meeting of the Board of Directors;]

OF DIRECTORS, FOR APPROVAL. >> WE WILL NOW RECONVENE THE REGULAR MEETING OF THE WOODLANDS, TEXAS. IT IS 7:38.

[16. Approve the 2024 Pool Schedule and proposed amendments to Township Order 020-09 related to Pool and Park Fees;]

THAT BRINGS US TO AGENDA ITEM 16 . I CALL FOR EMOTION AND SECOND TO APPROVE THE PROPOSED AMENDMENTS WE HEARD TO TOWNSHIP BOARD ZERO DASH 09 RELATED TO THE POOL AND PARK FEES. IS

VERY MOTION? >> SO MOVED.

>> MOVED AND SECONDED. COMMENTS, QUESTIONS? IF NOT, ALL THOSE IN FAVOR , SIGNIFY BY SAYING AYE. ALL OPPOSED? JAN

[18. Receive, consider and act upon information regarding a Homelessness Task Force (as requested by Director Heiser);]

EIGHT PICK THANK YOU. THAT BRINGS US TO AGENDA ITEM 18, AGENDA ITEM 17 WAS PULLED. I REFER YOU TO PAGES 61 TO 62 , REGARDING A HOMELESS TASK FORCE AS REQUESTED BY CINDY HEISER AND I WILL TURN IT OVER TO CINDY HEISER.

>> THANK YOU. THIS BOARD ATTEMPTS TO ADDRESS PROBLEMS PROACTIVELY AND IN A TIMELY AND EFFICIENT MATTER -- MANNER AS THEY ARE PRESENTED. IT HAS COME TO MY ATTENTION THROUGH MY CAMPAIGN AND FROM CONSTITUENTS THAT WE MIGHT NEED TO TAKE A LOOK AT SEEKING TO ESTABLISH A GUIDELINE FOR HANDLING THE INCREASES WE ARE SEEING IN PANHANDLING, HOMELESSNESS, CAMPING IN THE AREA , WITH THE GOAL OF PROTECTING THE WELL-BEING OF CONSTITUENTS, VISITORS, TAXPAYERS, AND ALSO, HELPING THOSE WHO NEED IT GET HELP. THESE GUIDELINES WILL

[01:40:01]

UNITE THE CAPABILITIES OF OUR CURRENT STAKEHOLDERS IN THE AREA TO DELIVER ASSISTANCE WHERE NEEDED AND IS SOLUTION ORIENTED APPROACH TO AN ISSUE THAT CAN BE COSTLY TO COMMUNITIES IF THERE IS NO PLAN IN PLACE AND I AM ASKING THAT WE ESTABLISH A TEMPORARY TASK FORCE TO ADDRESS THE

ISSUES. >> THANK YOU . I WOULD LIKE EITHER MS. SHARP OR LEGAL COUNSEL FOR THE LEGAL OPINION, IF THIS IS SOMETHING WE CAN DO.

>> WE HAVE THAT WE DON'T HAVE THE FORMAL WRITTEN OPINION, BUT WE DO KNOW THAT , WE DO BELIEVE IT CAN FIT UNDER THE PUBLIC SAFETY UMBRELLA OF WHAT THE TOWNSHIP HAS AUTHORITY TO DO. THE NEXT STEPS WOULD BE , IF THE BOARD APPROVES , IT GIVES THE STAFF DIRECTION TONIGHT THAT WE WOULD MOVE FORWARD WITH DEVELOPING A CHARTER FOR THIS TASK FORCE AND AT YOUR NEXT MEETING YOU WOULD ALSO ASSIGN, EVEN MAKE THE APPOINTMENTS TO THE TASK FORCE.

>> I'M SO, I AGREE IT IS SOMETHING THAT NEEDS TO BE LOOKED AT. HOW DO YOU ENVISION THE TASK FORCE OPERATING ? IS IT MORE INFORMATIONAL AND TRYING TO WORK WITH AUTHORITIES AND FOLKS I CAN ACTUALLY GET SOMETHING DONE BECAUSE CLEARLY, WE AS STAFF CAN GO OUT AND MOVE PEOPLE WILL DO ANYTHING LIKE THAT. I AM CURIOUS FROM A CONCEPTUAL STANDPOINT. REALLY, WE HAVE A LOT OF THE RESOURCES IN PLACE THAT WE DON'T HAVE A CLEAR , POLICY OR GUIDELINE AS TO HOW TO HANDLE ANY OF THESE ISSUES. OUR LAW ENFORCEMENT HAS DONE AN AMAZING JOB . THE ISSUE IN THE PAST, WE DIDN'T HAVE MUCH OF AN ISSUE BUT THE ISSUE HAS GROUNDS SINCE COVID. THERE'S BEEN A 17% INCREASE I BELIEVE , SO, CLEARLY IT'S GROWING. WE WOULD LIKE TO DETER FUTURE PROBLEMS BY COLLABORATING .

>> DO YOU INTEND TO HAVE THIS?

>> I THINK IT WILL BE A COUPLE OF US.

>> DIRECTOR? >> HOW DOES THIS FIT IN WITH THAT HOMELESSNESS COALITION OR WHATEVER THAT WAS CALLED?

>> I'M GLAD HE INTRODUCE THAT. I WISHED I'D BEEN ABLE TO TALK TO HIM BEFORE BECAUSE I'D BEEN IN CONTACT WITH THEM TO SEE HOW THEY WERE HANDLING HOMELESSNESS AND THEIR ISSUES, LOOKING FOR INFORMATION AND TRYING TO FIND OUT WHAT THEY THOUGHT, IF THEY THOUGHT THERE WAS AN INCREASE IN HOMELESSNESS, JUST ON MY OWN.

>> I LOOK AT THAT MORE AS A TOOLBOX, RESOURCES THAT CAN HELP YOU, GUIDE YOU AND WHAT THEY DO AND HOW THEY DO IT AND WHAT WORKS, THINGS OF THAT NATURE.

>> SYDNEY ARRANGED A MEETING WITH HENDERSON AND RYAN GABLE AND MYSELF AND A COUPLE OTHERS , SO WE SPENT AN HOUR AND A HALF OR SO WITH THEM, GOING THROUGH IDEAS. SHE'S ALREADY CONTACTED LOTS OF AGENCIES SO AGAIN, IT'S NOT TO PUSH THESE PEOPLE OUT , IT'S, LET'S EDUCATE OUR COMMUNITY THAT THE BEST THING IS TO GIVE THEM CARDS TO INTERFACE, OR THERE'S

WAYS AROUND IT. >> ONE THING I RECOMMEND, MY PARENTS, CALL IT THE TEXAN IN ME, SEND ME PICTURES. I KNOW ONE AREA THIS HAS HAPPENED A LITTLE BIT IS A RIVER AUTHORITY PROPERTY. WORKING WITH SOME OF THOSE AREAS WHERE WE CAN , THEY GIVE US PERMISSION TO GIVE LAW ENFORCEMENT PERMISSION, I THINK THAT'S IMPORTANT TO COLLABORATE WITH THE DIFFERENT STAKEHOLDERS .

>> EXACTLY. >> FOR CLARIFICATION, IF THE BOARD WANTS TO CONSIDER THIS AND ARE FAVORABLE, THE NEXT

STEPS WOULD BE -- >> THE MOTION WOULD BE TASK STAFF TO PURSUE THE DEVELOPMENT OF A CHARTER AND TO BRING THAT BACK AT THE NEXT MEETING.

>> SO MOVED. >> SECOND.

>> WELL, IT'S BEEN MOVED AND SECONDED . ALL IN FAVOR,

SIGNIFY BY SAYING AYE . >> AYE .

>> ALL OPPOSED? MOTION PASSES. THANK YOU FOR IDENTIFYING A PROCESS THAT WE CAN LOOK AT TO COLLABORATE WITH OTHER

[19. Receive, consider and act upon an update on The Woodlands Township Board Operations Policy;]

ENTITIES. THAT BRINGS US TO AGENDA ITEM 19, RECEIVE, CONSIDER, AND ACT UPON AN UPDATE ON THE BOARD OPERATIONS POLICY. THIS IS SOMETHING THAT WE HAVE DONE A NUMBER OF

[01:45:02]

TIMES. IT'S NOT JUST THIS EVENING . SINCE INCEPTION OF THE TOWNSHIP , THERE'S BEEN 13 DIFFERENT AMENDMENTS TO OUR BOARD POLICIES AND I AM GOING TO TURN THAT OVER TO DIRECTOR WATSON. HE ASKED FOR IT TO BE ON THE AGENDA.

>> THANK YOU. I'M TRYING TO GET CLOSER TO THE MICROPHONE, I'M NOT HIDING, AND TRYING --

>> IT LOOKS LIKE YOU SHRUNK SIX INCHES.

>> YOU ARE SHORTER THAN I AM. >> SO, I THINK WE ALL AGREE IT'S EXTREMELY IMPORTANT FOR THE PUBLIC TO HAVE A VOICE. BY NO MEANS IS MY REQUEST TO PUT THIS ON AN INTENT TO QUIET THE PUBLIC OR STOP ANY KIND OF PUBLIC COMMENT . AFTER HAVING BEEN ON THE BOARD FOR A YEAR AND EXPERIENCING OUR MEETINGS AS WELL AS GOING TO A NUMBER OF OTHER CITY COUNCIL, ISD, ALL KINDS OF GOVERNMENTAL ENTITIES AND MUNICIPALITY MEETINGS OF ELECTED OFFICIALS, I HAVE BEEN ABLE TO WATCH HAVE DIFFERENT BODIES HANDLE THEIR MEETINGS AND I THINK THAT THERE ARE WAYS THAT WE CAN DO IT TO STILL ACCOMPLISH THOSE GOALS BUT BE MORE EFFICIENT AND PREVENT WHAT I CONSIDER TO BE SOME ABUSES. I WILL EXPOUND UPON THAT BUT OFTEN TIMES, WE GET LARGE GROUPS, VERY LARGE GROUPS, THAT COME IN WITH A LOT OF PEOPLE WHO WILL SIGN UP WITH NO INTENTIONS OF SPEAKING, JUST TO GIVE THEIR TIME AWAY, OR IT BECOMES EXTREMELY DUPLICATIVE AND REPETITIVE. I DON'T THINK THE PUBLIC COMMENT SECTION IS INTENDED TO BE A FORUM FOR EFFECTIVELY A PROTEST, WHICH I FEEL WE'VE ENCOUNTERED ON NUMEROUS OCCASIONS. THAT SAID, I HAVE SOME RECOMMENDATIONS AND MOTIONS I WOULD LIKE TO MAKE IN TWO AREAS. DO I NEED TO MAKE THOSE MOTIONS AT ONCE OR

CAN I MAKE MORE THAN ONE? >> YOU CAN MAKE MORE THAN ONE

MOTION. >> I FELT LIKE IT MIGHT BE EASIER TO DO IT IN TWO. THE FIRST IS WITH RESPECT TO THE PUBLIC COMMENT PERIOD. I WOULD MOVE THAT WE MAINTAIN OUR THREE-MINUTE AMOUNT , HOWEVER, IF MORE THAN 15 SPEAKERS SIGN UP, FOR A MEETING, THAT AMOUNT WILL REDUCE TO TWO MINUTES.

AND, I DON'T BELIEVE YOU SHOULD BE ABLE TO DO FOR YOUR TIME . THAT'S NOT PROVIDED IN OUR EXISTING POLICIES AND PROCEDURES , CORRECT ME IF I'M WRONG, BUT WHEN I READ THEM, I DON'T SEE THAT. I THINK THAT'S JUST A GRACIOUS OR GRATUITOUS ACT PROVIDED OVER TIME AND STUCK. I WOULD LIKE TO MAKE THAT MOTION THAT WE STAY AT THREE MINUTES BUT IF WE HAVE MORE THAN 15 SPEAKERS SIGN UP IN AN EVENING, IT DROPS TO TWO AND YOU CAN'T DO FOR YOUR TIME. IF A SPEAKER NEEDS TO GO OVER THERE TWO OR THREE MINUTE, I WOULD PROPOSE THE BOARD CAN TAKE A QUICK VOTE AS TO WHETHER WE WANT TO ALLOW AN ADDITIONAL

TWO OR THREE MINUTES . >> MAY I JUST SAY --

>> CANNOT DUMP IT >> YOU SAID SOMETHING THAT THE POINT OF INFORMATION THAT YOU SAID IT'S NOT IN OUR CURRENT

REGULATIONS, IT IS. >> THAT YOU CAN DEFER? WILL YOU

DIRECT ME TO THAT? >> PAGE 3 OF 9. IT SAYS THAT THEY CAN YIELD , SPEAKERS WILL BE TAKEN IN THE ORDER IN WHICH THEY SIGNED UP AND WE YIELD THEIR TIME TO ANOTHER SPEAKER

ON THE LIST. >> THAT IS WHAT I WANT STRICKEN. THAT IS MY MOTION WITH RESPECT TO THE PUBLIC

COMMENT PERIOD >> JUST FOR CLARIFICATION, IS IT AFTER'S 15 TOTAL OR 15 ON ONE AGENDA TOPIC?

>> 15 TOTAL. >> YOU HAVE ONE ISSUE THAT YOU ARE PUTTING FORTH AN EMOTION?

>> ONE FOR THE PUBLIC COMMENT CHANGES.

>> OKAY. >> I WILL PLAY DEVILS ADVOCATE.

I AM NUMBER 14. I HAVE THREE MINUTES OF SOMETHING THAT IS A COMPLETELY DIFFERENT TOPIC THAN ANYONE ELSE TALKED ABOUT BUT BECAUSE AND 14, I GET TWO MINUTES.

>> NO, MORE THAN 15. >> CAN I CLARIFY ? RIGHT NOW WE DO NOT HAVE ANYONE INDICATE THE SUBJECT MATTER ON WHICH THEY ARE SEE -- SPEAKING ON THE SIGN-UP.

>> A LOT OF TIMES THEY DON'T ANSWER THAT. A LOT OF THE DISTINGUISH MINTS FROM OTHER BODIES THAT I HAVE DISCUSSED EITHER MAKE YOU SPEAK AT THE END AT A DIFFERENT TIME OR THEY

[01:50:02]

GIVE YOU A DIFFERENT AMOUNT OF TIME, A GENERAL COMMENT --

>> TRYING TO ANSWER -- >> RIGHT NOW WE HAVE NAME, ADDRESS, PHONE, EMAIL, SUBJECT, AGENDA ITEM AND THEN WHO THEY REPRESENT AND IF THEY HAVE A HANDOUT. BUT, FOR INSTANCE, SOME DO NOT FILL THAT OUT AT ALL OTHER THAN THEIR NAME.

>> I THINK, YOU ARE SAYING THAT 15 PEOPLE SIGN UP ON A SUBJECT MATTER THEN IT AUTOMATICALLY GOES TO TWO

MINUTES? >> I'M HAPPY TO DISCUSS THAT.

AT SOME POINT, THERE ARE A LOT WHERE IT IS MORE THAN FIVE SPEAKERS. ONCE WE GET TO THAT NUMBER OF SPEAKERS , GENERALLY, IF YOU ARE GOING TO HAVE THAT VOLUME OF SPEAKERS, IT BECAUSE YOU'VE GOT AN ISSUE WHERE YOU HAVE A HUGE GROUP COMING IN AND RATHER THAN THEN GETTING A COUPLE PEOPLE , IT GETS

REPETITIVE AND DUPLICATIVE. >> ONE THING I WOULD LIKE SO THAT THE BOARD KNOWS IS IN 2019, THE STATE PASSED HOUSE BILL 3480 , THAT STATE LAW, STATES ANY ATTENDEE MUST BE ALLOWED TO SPEAK ON AN ITEM ON THE AGENDA. IT DOES NOT DESIGNATE THREE MINUTES, FIVE MINUTES, 30 SECONDS. HOWEVER, IT ALSO WENT ON TO SAY THAT IT DOES NOT REQUIRE TO ALLOW ANY ITEM NOT ON THE AGENDA FOR SOMEONE TO SPEAK AND THAT IS STATE LAW. ANYONE WHO COMES IN, IF WE HAVE 300 PEOPLE WHO ATTEND, ALL 300 HAVE THE OPPORTUNITY TO ADDRESS --

>> THEY'LL HAVE TWO MINUTES UNDER MY MOTION.

>> THEY'LL HAVE THE OPPORTUNITY .

>> FIRST OF ALL, I THINK THEY SHOULD FILL THAT OUT COMPLETELY OR THEY SHOULD NOT BE SPEAKING. I THINK WE SHOULD KNOW WHO THEY ARE AND WHAT THEY ARE SPEAKING ABOUT.

>> RARELY DO THEY LISTEN AGENDA ITEM.

>> REGARDING THAT, I THINK ONE OF THE REASONS PEOPLE ARE COMING HERE IS BECAUSE THEY FEEL LIKE THEY DO HAVE A VOICE AND THEY ARE WELCOME TO BRING ISSUES TO US THAT COULD BE ON THE AGENDA OR COULD HAVE BEEN ON THE PAST AGENDA BUT THEY JUST FOUND OUT ABOUT AND THEY HAVE THINGS THEY REALLY WANTED TO SHARE OR, WE HAVEN'T HEARD ABOUT IT BUT THEY ARE BRINGING IT TO US, THEY ARE OUR EYES AND EARS IN THE COMMUNITY AND WE ARE RESPONSIBLE TO THEM AND THEY ELECTED US, SO I THINK WE HAVE TO BE VERY WELCOMING. I WANT TO CONTINUE THAT ATTITUDE.

IN THE PAST, I KNOW THAT WHEN SHERMAN BUNCH WAS HERE, HE WOULD REACH OUT TO THE AUDIENCE AT THE END OF THE LISTED PUBLIC COMMENT AND SAY, IS THERE ANYONE ELSE IN THE AUDIENCE WHO WOULD LIKE TO SPEAK , BEFORE WE CLOSE PUBLIC COMMENT, AND THAT WAS VERY , A GRACIOUS EFFORT TO WELCOME EVERYONE. THERE'S A LOT OF DISCRETION THE CHAIRMAN CAN TAKE ON THINGS LIKE THIS , BUT I DON'T WANT THIS BOARD TO BE VIEWED AS NOT A WELCOMING BOARD , THAT ENCOURAGES PARTICIPATION FROM THE COMMUNITY. I, MYSELF THINK THAT IS ONE OF OUR ATTRIBUTES, THE HERALDS WE HAVE . IT'S AN ACKNOWLEDGMENT OF OUR COMMUNITY NEEDS , I THINK. THEY LOVE COMING HERE TO TALK TO US. ONLY WHEN IT'S IMPORTANT, RIGHT? TO COME AND FIND OUT THEY CAN'T SPEAK OR THEY ARE BEING REDUCED IS, I DON'T THINK WELCOMING. THE OTHER THING ABOUT IT , THE YIELDING OF TIME HAS ALLOWED , AND THIS HAPPENS IN CONGRESS, YOU CAN YIELD YOUR TIME IN CONGRESS TO ANOTHER SPEAKER, AND THAT USUALLY IS DONE BECAUSE THAT OTHER SPEAKER HAS MORE INFORMATION OR IS A BETTER SPEAKER OR IS MORE OF A SUBJECT MATTER EXPERT SO THE YIELDING OF TIME HAS A RICH TRADITION AND I DON'T THINK WE OUGHT TO ELIMINATE YIELDING OF TIME. THOSE TWO THINGS, THE OTHER THING YOU MENTIONED, LEARNING FROM OTHER PEER CITIES OR ENTITIES, GOVERNMENT ENTITIES, IS THAT YOU CAN SIGN UP DIGITALLY THROUGH THE INTERNET , AND SPEAK AT A CITY COUNCIL MEETING . YOU DO THAT TO THE INTERNET AND I THINK THAT IS SOMETHING WE SHOULD LOOK AT AS ANOTHER WAY TO FACILITATE MORE PEOPLE GETTING INVOLVED AND COMING. AND NOT REDUCE IT. WE NEED TO MAKE IT MORE WELCOMING AND I DON'T WANT TO GET RID OF THE

[01:55:01]

SIGN-UP AT THE DESK . THAT'S GOOD, TOO, BUT I THINK THAT IF WE DON'T PUT ANY MORE RESTRICTIONS ON THE NECESSARY, YOU CAN ALSO SIGN UP ON THE WEBSITE AND THEN THEY KNOW WHERE THAT IS AND THEY CAN SIGN UP AND GIVE ALL THE REQUIRED INFORMATION YOU'RE SPEAKING OF BECAUSE YOU WOULDN'T BE ABLE TO COMPLETE THE REGISTRATION AND TILLOTSON.

SUGGESTION ON THIS. I DON'T THINK IN ANY WAY , AND I WILL USE THE 15 TOTAL, I THINK THAT'S MORE THAN GENEROUS FOR THREE MINUTES AND THEN FOLLOWING THAT, TWO MINUTES , IN ANY WAY RESTRICTS INDIVIDUALS FROM COMING AND ADDRESSING THE BOARD. I'VE BEEN ON THE BOARD, THIS IS MY FIFTH TERM , AND WE NEVER NOT ALLOWED PEOPLE TO SPEAK. WHAT I HAVE SEEN IS THAT IT'S MORE EFFICIENT AND MORE EFFECTIVE AND IF PEOPLE REALLY HAVE A PASSION OR WANTS TO ADDRESS THE BOARD ON AN ISSUE, THEY NEED TO SPEAK, THEMSELVES, TO WHAT THAT ISSUE IS. I FEEL THAT THE THREE MINUTES FOR 15 AND IF IT'S GREATER THAN 15, TWO MINUTES, WE COULD HAVE 300 PEOPLE AND EVERY SINGLE ONE OF THE 300 WOULD HAVE TIME TO

SPEAK. >> BEFORE THE VOTE, POINT OF CLARIFICATION. IF YOU ARE NUMBER 16, THAT INDIVIDUAL WOULD GET TWO MINUTES BUT THE EARLIER 15 WOULD GET THREE

MINUTES? >> NO, EVERYONE WOULD GET TWO.

IF IT SIGN UP -- IF AT SIGN-UP IT IS MORE THAN 15, THAT'S THE INTENT, TO CREATE EFFICIENCY AND MOVE IT TO TWO MINUTES WHICH A LOT OF MUNICIPALITIES DO ONE MINUTE IF OVER FIVE

SPEAKERS. >> WHEN WE SPOKE AT THE HARRIS COUNTY COMMISSIONERS COURT, YOU HAD ONE MINUTE. YOU WERE ABLE , YOU SPOKE AT THAT . IT YOU MAKE YOUR COMMENTS TO BE EFFECTIVE, EFFICIENT, AND WE WERE ALL ABLE TO GET OUR POINT ACROSS. THE MAC SO, WHERE ARE WE NOW?

>> MY MOTION IS THAT WE AMEND THE EXISTING BOARD POLICIES , WHEREBY THE TIME FOR PUBLIC COMMENT REMAINS AT THREE MINUTES UNLESS THERE ARE MORE THAN 15 SPEAKERS THAT HAVE SIGNED UP AND IF THERE ARE, THOSE SPEAKERS ARE ALL THEN ALLOTTED TWO MINUTES, AND YOU CANNOT DO FOR YOUR TIME POINT

>> MADDEN CHAIRMAN? CAN I ADD ANYTHING ELSE?

>> I THINK THAT THE GREAT IDEA, HONESTLY, FOR EFFICIENCY. IN ADDITION TO THAT , I LIKE SIGNING UP AHEAD OF TIME BECAUSE THERE MIGHT BE SOME ISSUES WE COULD, THAT COULD BE TAKEN CARE OF WHERE THE PEOPLE DIDN'T, I HAVE FRIENDS WHO WON'T COME SPEAK PUBLICLY AND HAVE ISSUES THEY WOULD LIKE , SO IF THERE WERE AN ONLINE SIGN-UP, I HAVE AN ISSUE, SOME THINGS MIGHT BE ABLE TO BE TAKEN CARE OF BEFORE THE BOARD

MEETING. >> I WILL LET LEGAL COUNSEL ADDRESS THAT. I DON'T THINK --

>> I THINK THERE ARE TWO ISSUES BEING MENTIONED AND THAT THE ABILITY TO SIGN UP AHEAD OF TIME AND THAT SIMPLY AN ADMINISTRATIVE PROCESS THE STAFF WILL HAVE TO FIGURE OUT , WHETHER THAT CAN BE DONE OR NOT. TAKING CARE OF THINGS AHEAD OF TIME , I THINK WHAT YOU ARE SAYING IS THERE MAY BE PEOPLE WHO COULD REACH OUT TO A DIRECTOR AND SAY HEY, HERE'S THE PROBLEM I HAVE, AND THE DIRECTOR, NOT AS A GROUP, THAT INDIVIDUALLY COULD SAY, HERE'S WHAT I THINK NEEDS TO GET DONE AND THEN THEY SAY, I DON'T NEED TO COME, IS THAT WHAT YOU'RE SAYING? THAT'S ALSO JUST ADMINISTRATION OR STAFF.

YEAH. IT'S THE SAME. I GUESS THAT'S NOT REALLY A BOARD POLICY ISSUE, THAT'S JUST SIMPLY AN NARRATIVE ON THE FACT THAT PRE-SIGN-UP MIGHT BE MORE EFFICIENT. IS THAT FAIR?

>> I THINK THAT PRE-SIGN-UP , THEY MAY SIGN UP AHEAD OF TIME AND THEN NOT COME AND NOW WE ARE LOOKING AT 16 PEOPLE BUT

FIVE AREN'T HERE. >> AND YOU ARE NUMBER 16.

>> BUT THAT'S THE DISCRETION OF THE CHAIRMAN , IF THEY ARE NOT HERE YOU DON'T HAVE TO IMPLEMENT, IF , I DON'T KNOW, IT'S POSSIBLE, IT COULD CAUSE TROUBLE, BUT IT DOESN'T SEEM

TO OTHER PLACES. >> WE'VE HAD SEVERAL TIMES WHEN PEOPLE HAVE SIGNED UP AND THEY'VE LEFT , AND THE DEFERRED AND SOMEONE HAS GONE UP INSIDE, JOHN SMITH DEFERRED HIS TIME TO ME, AND I SAID, LOOK, JOHN SMITH WALKED OUT

[02:00:03]

THE DOOR. >> THAT'S TRUE. BUT I DON'T THINK THAT WOULD HAPPEN HERE BECAUSE YOU CAN'T DEFER UNLESS YOU ARE HERE IN PERSON TO YIELD AND IT'S NOT DEFER,

IT'S HEALED. >> THE MOTION ON THE FLOOR --

>> LET ME CLARIFY ONE ISSUE, THE 15 , 15 ON THE SUBJECT

MATTER? >> TOTAL SPEAKERS. THE MAC

SIGNED UP ON ANY SUBJECT. >> CORRECT.

>> COULD BE 15 DIFFERENT TOPICS.

>> THAT'S 45 MINUTES RIGHT THERE.

>> WILL YOU RESTATE YOUR MOTION SO THERE'S NO

CONFUSION? >> BOY. SURE.

>> MY MOTION IS , THIRD RECITATION, THAT THE TIME TO SPEAK, THE POLICIES OF THE BOARD, WITH RESPECT TO THE PROVISIONS AND TERMS RELATED TO PUBLIC COMMENT BE AMENDED SO THAT THE TIME FOR AN INDIVIDUAL OR RESIDENT TO SPEAK REMAINS AT THREE MINUTES UNLESS MORE THAN 15 SPEAKERS HAVE SIGNED UP TO SPEAK , IN WHICH CASE THAT THREE MINUTES IS REDUCED TO TWO MINUTE AND YOU ARE NOT ALLOWED TO DO FOR

YOUR TIME TO SOMEONE ELSE. >> SECOND.

>> MADE BY DIRECTOR WATSON, SECONDED BY DR. ANN K. SNYDER

DID >> BEFORE WE VOTE, CAN I ADD ONE THING? WHERE WE CURRENTLY TALK ABOUT THAT IN THE POLICY, IT ALSO NOTES IN ACCORDANCE WITH STATE LAW THAT SOMEBODY WHO NEEDS THE TRANSLATOR HAS A LONGER AMOUNT OF TIME, SO THEY HAVE SIX MINUTES INSTEAD OF THREE MINUTES,

>> I DO NOT INTEND TO REVISE ANY EXCEPTIONAL CIRCUMSTANCE.

>> OKAY. >> NO OTHER COMMENT . DO YOU

WANT TO TAKE A HANDS OR -- >> ALL IN FAVOR, SIGNIFY BY

SAYING AYE PAID >> NO, ROLL CALL.

>> I THOUGHT YOU SAID NO . OKAY. DIRECTOR BAILEY?

>> YES. DIRECTOR FRANKS? >> YES. YEAR.

>> RECTOR NELSON. >> DID

>> KNOW. >> DIRECTOR WATSON?

>> YES. >> AND DIRECTOR SNYDER. YES.

THE MOTION PASSES, 6-1, TO AMEND THE POLICY. I BELIEVE

THAT YOU HAD A SECOND BID >> YES, MY SECOND MOTION WITH RESPECT TO THE AMENDMENT A POLICY IS WITH RESPECT TO ADDING AGENDA ITEMS . I THINK THAT YOU SHOULD HAVE TO HAVE A SECOND TO ADD AGENDA ITEMS , NOT JUST ONE BOARD MEMBER , CERTAINLY I'M COGNIZANT OF THE FACT OF THE OPEN MEETINGS ACT SO YOU CAN'T GO OUT AND GET A MAJORITY OF SUPPORT BUT WE ARE SUPPOSED TO BE ADDING , FOR MOST ITEMS GOING ON THE AGENDA, IT SHOULD BE DONE IN PUBLIC SESSION. I KNOW THERE'S LANGUAGE THAT THEY CAN BE ADDED WITH THE CHAIRPERSONS APPROVAL , BUT I BELIEVE THAT FOR PURPOSES OF MAKING SURE THAT THE STAFF IS PROTECTED AND THAT WE ARE NOT WASTING BOARD AND STAFF TIME AND RESOURCES, YOU SHOULD AT LEAST BE ABLE TO HAVE THE SUPPORT OF ONE MORE BOARD MEMBER BEFORE YOU GET TO PUT SOMETHING ON THE AGENDA AND THEN REQUIRE EFFORT AND WORK AND TIME BE SPENT ON THAT ISSUE.

>> OKAY. COMMENTS FROM BOARD MEMBERS? I KNOW, AUGUST 20, 2020, IT WAS WHEN IT WAS CHANGED, THAT NEEDED THE CHAIRMAN APPROVAL TO PUT SOMETHING ON THE AGENDA.

>> WHERE IS THIS LOCATED , THIS DOCUMENT?

>> IT IS, LET ME FIND IT AGAIN.

>> KAREN PROBABLY HAS IT MEMORIZED.

>> PAGE TWO, ESTABLISHING THE AGENDA . ANY DIRECTOR MAY REQUEST ITEMS BE PLACED ON A BOARD AGENDA AND A SINGLE DIRECTOR MAY MAKE A REQUEST FOR A FUTURE AGENDA ITEM IN OPEN SESSION OF A BOARD MEETING AND THE ITEM WILL BE ADDED TO A FUTURE AGENDA AS REQUESTED. A REQUEST FOR A FUTURE AGENDA ITEM OUTSIDE OF THE POSTED MEETING SHOULD BE MADE BY CONTACTING THE CHAIRMAN OR THE PRESIDENT, GENERAL MANAGER , BUT ITEMS REQUESTED OUTSIDE THE POSTED BOARD MEETING MUST BE APPROVED FOR PLACEMENT ON THE AGENDA BY THE CHAIRMAN IN ORDER TO BE INCLUDED ON THE NEXT REGULAR SESSION. IF THE CHAIRMAN DOES NOT APPROVE THE AGENDA ITEM, THE REQUEST WILL BE HELD UNTIL THE DIRECTOR CAN PUBLICLY REQUEST THE AGENDA ITEM AT A POSTED BOARD OF DIRECTORS MEETING WHICH INCLUDES ALL TOPICS AND INCLUDES PROCLAMATIONS.

>> THAT SECOND LANGUAGE IS EFFECTIVELY REQUIRING A SECOND BY VIRTUE OF THE CHAIRMAN'S APPROVAL WHICH I AM FINE WITH, BUT IN A PUBLIC SETTING , I DON'T BELIEVE ANY SINGLE DIRECTOR SHOULD BE ABLE TO PUT SOMETHING ON THE AGENDA WITHOUT

[02:05:02]

A SECOND FROM ANOTHER BOARD MEMBER.

>> ALL OF THAT PARAGRAPH JUST READ WAS AMENDED AUGUST

20TH, 2020. >> I THINK THAT MAKES IT VERY FAIR TO ALL THE PEOPLE AT THE DAIS , BECAUSE IF IT'S A SITUATION WHERE THE SEVEN OF YOU UNITE AGAINST MYSELF BECAUSE , THE SIX OF YOU, RATHER, UNITE AGAINST MYSELF, THAT EFFECTIVELY CANCELS ME AND SILENCES NEED. I WILL NOT BE ABLE TO EVER PUT IN AGENDA ITEM ON BECAUSE YOU WON'T GIVE ME A SECOND AND I THINK THAT'S REALLY DISINGENUOUS TO WHAT HAPPENS IN AN ELECTION. THE ELECTION HAPPENS, I AM EKE WITH ALL OF YOU AT THIS BOARD, WE ALL HAVE THE SAME VOTE , BUT SETTING OF THE AGENDA IS VITAL TO THE BUSINESS OF THE BOARD AND IF I CANNOT ADD AN AGENDA ITEM, I AM BEING SILENCED .

>> YOU ARE SPEAKING IS THAT YOU FEEL SINGLED OUT, IT'S NOT ABOUT YOU AND PEOPLE AGAINST YOU, DIRECTOR GIVES. IF ANY OF US CANNOT EVEN GET A SECOND ON AN ISSUE, IT'S DEAD ON ARRIVAL AND IF THERE WAS EVER A VOTE DOWN THE LINE, IT'S NOT GOING ANYWHERE. IT'S NOW AN EXERCISE IN FUTILITY IN WHICH WE ARE MAKING OUR STAFF THAT WE ARE PAYING FOR HAVE TO GO JUMP THROUGH HOOPS AND DO DIFFERENT THINGS AND COME UP HERE AND DO A PRESENTATION FOR SOMETHING THAT HAD NO SUPPORT FROM THE

BEGINNING. >> I DISAGREE.

>> IF I MAY, AUGUST 20TH, 2020 , YOU MADE THE COMMENT THAT WHEN YOU SERVED ON THE HOUSTON CITY COUNCIL, IT WORKED EFFECTIVELY TO HAVE A SECOND FOR ANY AGENDA ITEM .

>> THAT'S NOT TRUE. I DID NOT SAY THAT BECAUSE WE DID NOT SET THE AGENDA, IT WAS A STRONG MAYOR FORM OF GOVERNMENT AND THE MAYOR SETS THE AGENDA. WE HAD TO HAVE SECONDS FOR MOTIONS AND TABLING , BUT WE DID NOT SET THE AGENDA SO

THAT'S NOT CORRECT. >> I WILL SAY , DIRECTOR GIVES, TO YOUR POINT BEEN , THE SIX OF US WILL NEVER SUPPORT YOU, THAT'S NOT TRUE BECAUSE LAST MONTH I MADE A SECOND ON YOURS ON THE JULY 4TH QUESTION . IF YOU, IF WE PROVIDE A GOOD ARGUMENT AND A BASIS FOR HAVING IT, I THINK EVERY SINGLE ONE OF US WOULD SECOND SOMETHING THAT NEEDS TO BE HEARD AND NEEDS TO BE FURTHER LOOKED INTO.

>> POSSIBLY, BUT I'LL GIVE YOU THE POINT OF, THE BATHROOM ISSUE AT CAPSTONE PARK . IF IT HAD NOT BEEN FOR ME RINGING THAT ISSUE UP , MUCH PERHAPS TO THE DISAGREEMENT OF SOME ON THIS BOARD, WE WOULD NOT HAVE BEEN ABLE TO EVENTUALLY SOAR IT THROUGH AND MAKE THE CHANGES TO THE BENEFIT OF THE RESIDENCE AND THAT DID REQUIRE QUITE A BIT OF EFFORT ON A LOT OF THE RESIDENCE PART AND MY PART BUT EVENTUALLY, THEY CAME TO FRUITION THAT THAT WAS NOT A DESIRABLE FEATURE. THEY DID NOT WANT A RESTROOM AND CAPSTONE PARK, SO I DON'T KNOW IF THAT'S WHAT HAS BROUGHT THIS TO THE TABLE TODAY DIRECTOR WATSON,BUT I THINK THAT WE NEED TO RECOGNIZE THAT SOMETIMES THINGS ARE UNPLEASANT BUT THEY STILL HAVE TO BE BROUGHT TO US AND STILL HAVE TO BE VOTED ON AND IF WE CAN'T HEAR FROM OUR RESIDENTS AND IF WE CAN'T PUT THINGS ON THE AGENDA EVEN FOR INFORMATION PURPOSES, IT DOESN'T HAVE TO ALWAYS BE VOTED ON, IT COULD BE FOR INFORMATION, THEN WE ARE RESTRICTING OUR ABILITY TO REPRESENT OUR RESIDENTS.

>> YOU ARE DOING THE SAME THING YOU DID WITH A PRIOR MOTION. I DIDN'T SAVE PEOPLE COULDN'T TALK, I PUT SAFEGUARDS IN PLACE TO PREVENT ABUSE. THAT'S EXACTLY WHAT I'M DOING. I'M NOT SAYING YOU CAN'T PUT SOMETHING ON THE AGENDA, BUT YOU SHOULD HAVE THE SUPPORT OF AT LEAST ONE OTHER PERSON, JUST LIKE ANY MOTION MADE REQUIRES A SECOND, TO PUT SOMETHING ON THE

AGENDA. >> I WOULD ALSO LIKE TO REITERATE, RESIDENCE CAN REACH ANY OF THE SEVEN OF US AND STAFF AT ANY TIME . JUST THIS AFTERNOON, I HAD A RESIDENT REACH OUT TO ME ABOUT THE ARBOR DAY PLANING AND WHERE TO PLANT TREES AND HOW AND WHAT AND WHY. I GOT WITH THE DIRECTOR AND RESPONDED IN DETAIL TO HIS QUESTION AND CONCERNS , AND IT WOULD HAVE BEEN, I DID THE SAME THING WITH CAPSTONE PARK RESTROOMS . PEOPLE REACHED OUT TO ME DIRECTLY, I RESPONDED TO THEM, I TALKED TO FRIENDS OF MINE , WHO LIVE THERE, WE HAVE A BOARD MEMBER WHO USED TO LIVE THERE THAT WAS NOT ON THE DIES OF THE TIME THAT CALLED ME AND SAID BRAD, I THINK YOU NEED TO LOOK AT THIS IN A DIFFERENT WAY, SIDEBAR, NOT FROM THAT PODIUM, BUT A SIDEBAR. WE ARE VERY OPEN TO PEOPLE REACHING OUT TO US. I'LL GIVE MY PERSONAL CELL

[02:10:01]

PHONE NUMBER TO PEOPLE. IT'S NOT LIKE WE ARE NOT TALKING TO PEOPLE OR NOT WANTING TO LISTEN TO GOOD IDEAS. I THINK THAT YOU ARE JUST CONCLUDING THE PROBLEM AND I THINK THAT WE ARE NOT TRYING TO SHUT ANYONE OUT, I JUST THINK WE HAVE TO START , I THINK SOMETIMES SHELLEY GETS A LITTLE POLITICS , THE POLITICAL ANGLE GETS A LITTLE DEEP AND LET'S START WORKING TOGETHER , GENERALLY, TO FIX PROBLEMS. I'M ALL ABOUT THAT.

>> AND THAT'S WHY I SECONDED YOUR DEAL ON THE FOURTH OF JULY. I WANTED TO BE THE CONTRACT. WE DIDN'T AGREE, BUT I DID THAT AND I WILL DO THAT FOR OTHER THINGS IF IT'S THE

RIGHT WAY TO GO. >> IN FACT, IT WAS A 5-2 VOTE.

MONTH AGO. >> OKAY. THERE'S A MOTION ON

THE FLOOR. >> COULD I JUST ASK, SO CURRENTLY, YOU DO HAVE TO APPROVE ANY AGENDA ITEM.

>> I HAVE ALWAYS BEEN OF THE STANDS THAT IF IT IS SAID IN PUBLIC OR IF IT GOES TO MONIQUE OR MYSELF , WE HAVE PUT

IT ON THE AGENDA. >> TO ME, IT SEEMS LIKE THAT WOULD BE IN ADEQUATE SAFEGUARD . I HEAR --

>> IT GIVES AN ENORMOUS AMOUNT OF AUTHORITY OR POWER, WHEN ALL THAT WAS PUT ON AUGUST 20TH OF 2020, TO ONE INDIVIDUAL. I REALLY THINK THAT WE ARE, ALL SEVEN, EQUAL IN THAT . I MIGHT SIT HERE, BUT I THINK THAT EACH AND EVERY BOARD MEMBER IS IMPORTANT , SO I THINK IF WE GO THROUGH, THERE'S NO REASON WE CAN'T HAVE THE SECOND ON THE AGENDA ITEM. SHELLEY, EXCUSE ME, DIRECTOR GIVES, WHEN WE TALKED ABOUT THE HOMESTEAD, YOU SECONDED SOMETHING FOR ME , AND IN CAPSTONE, I SECONDED SOMETHING FOR YOU. WE ARE, ALL SEVEN, EQUAL BOARD MEMBERS, BUT I THINK THAT THIS, AGAIN, IS SOMETHING THAT WOULD BE GOOD FOR THE BOARD.

>> WITH THE SECOND GO TO MONIQUE?

>> NO. >> IT'S MADE IN HERE.

>> IN OPEN SESSION. THE MAJORITY OF THE BOARD AGENDA IS DONE BY STAFF . MONIQUE'S EXECUTIVE LEADERSHIP TEAM. I DO NOT SET THE AGENDA. THAT IS PART OF , OTHERS MAY HAVE COME IN PAST, BUT THAT'S OUR PRESENT CEOS RESPONSIBILITY , IS IT NOT, FOR YOU TO SET THE AGENDA?

>> IT IS, THAT IS LISTED IN MY CONTRACT IN MY JOB DESCRIPTION THAT THAT IS ONE OF THE PRIMARY RESPONSIBILITIES. QUIETLY CLARIFY THAT IN THIS SECTION, AS WELL? BEEN A GOOD IDEA.

>> IF WE ARE GOING TO CLARIFY, CLARIFY ONE TIME.

>> IT DOES CURRENTLY STATE THAT IMMEDIATELY AFTER ESTABLISHING THE AGENDA, THE PRESENT GENERAL MANAGER IS RESPONSIBLE FOR DEVELOPING THE AGENDA IN ACCORDANCE WITH THE TEXAS OPEN

MEETINGS ACT. >> THAT PARAGRAPH --

>> I THINK THE RISK IS THAT WE HAVE, THE SHOE COULD FLIP . I KNOW WHEN CHAIRMAN SNYDER WAS SOMETIMES FEELING A LITTLE BIT LEFT OUT OR ISOLATED BEFORE THIS NEW BOARD CAME IN, YOU SPOKE TO THAT AND I THINK THAT IT IS HELPFUL BECAUSE I KNOW YOU, PERSONALLY, PUT IN PROCLAMATIONS. YOU PUT THINGS YOU REQUESTED AND YOU DID NOT HAVE TO GET A SECOND ON ANY OF THAT. IT WAS JUST BECAUSE THAT WAS --

>> IT WAS THROUGH CHAIRMAN BUNCH.

>> BUT HE ALLOWED PRETTY MUCH EVERYTHING YOU REQUESTED AND THE POINT WAS, IF YOU HAD NOT MADE THAT EFFORT IN PUBLIC SESSION IT WOULD HAVE HAPPENED, AT THE MEETING. YOU DID NOT REQUIRE A SECOND. GIVING IT , RESTRUCTURING IT THIS WAY BASICALLY GIVES THE BOARD THE ABILITY TO BE A SILENT VETO.

IF I OFFER SOMETHING FOR AN AGENDA ITEM AND I DON'T GET THE SECOND, IT'S IMMEDIATELY VETOED LIKE NOTHING, WE DON'T WANT TO HEAR ABOUT IT. WE DON'T WANT TO HEAR ABOUT IT. I THINK THAT'S PUTTING AN UNNECESSARY RESTRICTION ON WHAT OUR JOB IS, WHICH IS TO REPRESENT THE PEOPLE WHO ELECTED US, ALL OF THE WOODLANDS TOWNSHIP. I DON'T SEE THAT THIS IS EFFICIENT, I DON'T SEE THAT IT IS SOMETHING THAT WILL MAKE THE ADMINISTRATION , THE BOARD MEETING BETTER, I JUST SEE THAT IT A CANCELLATION OF MY RIGHTS AS AN ELECTED OFFICIAL. I HEARTILY SPEAK AGAINST IT AND ASK OTHERS TO JOIN ME IN NOT DOING THIS.

[02:15:02]

>> DO WE HAVE ANY EXAMPLES OF WHAT OTHER MUNICIPALITIES, WE HAVE THIS ON OPEN COMMENTS, IS THERE ANYTHING ON WHAT OTHER MUNICIPALITIES DO ON AGENDA ITEMS?

>> MS. DEMPSEY? >> WE HAVE NOT PERFORMED FOR RESEARCH ON THAT. WE DO ANECDOTALLY KNOW THAT THERE ARE SOME OTHER CITIES THAT DO THIS , BUT I DON'T HAVE THE METRICS THE WAY I DO WITH PUBLIC COMMENT.

>> MY PROBLEM WITH THE CURRENT SYSTEM IS THAT I BELIEVE IT ALLOWS FOR DIRECTORS, ANY OF US, TO REFUSE A POSITION AND TRIGGER ROLES AND DUTIES , EXPENDITURE OF TIME, EXPENDITURE OF RESOURCES , FOR THINGS THAT SOMEBODY MAY HAVE CALLED ON THE PHONE OR SOMETHING, THEY TALK TO SOMEBODY ABOUT, WHICH THEY ARE HAPPY TO VOICE AND IF YOU CAN'T VOICE THAT AND GET TRACTION FROM AT LEAST ONE OTHER BOARD MEMBER, THEN MY POINT REMAINS, IT'S NOT SOMETHING WE NEED TO FORCE THE STAFF TO SPEND TIME, ENERGY, AND MONEY ON, AND THAT'S MY POINT.

>> OKAY, IT'S BEEN MOVED AND SECONDED BY DIRECTOR SNYDER, MOVED BY DIRECTOR WATSON, OTHER COMMENTS? IF NOT, WE WILL TAKE A ROLL CALL VOTE. DIRECTOR BAILEY?

>> YES. >> DIRECTOR FRANKS?

>> YES. >> DIRECTOR CINDY HEISER?

>> I'M GOING TO VOTE NO. >> DIRECTOR NELSON?

>> YES. >> DIRECTOR DR. SHELLEY

SEKULA-GIBBS. >> NO POINT

>> DIRECTOR WATSON? >> NO.

>> DIRECTOR SNYDER, YES. IT IS BY -2, PASSES BY -2.

>> I HAVE A MOTION. >> THAT BRINGS US, IF THERE IS

ADDITIONAL -- >> I HAVE A MOTION.

>> I HAVE A MOTION. I'VE HAD , MY FIRST YEAR, I'VE HAD THIS DOCUMENT PUT IN FRENEMY FOR EDUCATION MORE THAN A FEW TIMES , AND IN READING IT, I FEEL LIKE THERE'S , YOU KNOW, SOME THINGS THAT ARE NOT, THAT LIKE PAGE 7 OF 9, THE PRESIDENT AND GENERAL MANAGER , THERE ARE TWO BULLET POINTS OF WHAT MONIQUE DOES . WE ALL KNOW MONIQUE HAS A LONG AND DISTINGUISHED LIST OF DUTIES AND RESPONSIBILITIES . I REACHED OUT TO OUR HUMAN RESOURCES DEPARTMENT AND GOT MONIQUE'S DUTIES AND RESPONSIBILITIES , I HAVE COPIES FOR EVERYBODY HERE. IF YOU COULD PASS THEM DOWN. I WOULD LIKE TO AMEND MONIQUE'S DUTIES AND RESPONSIBILITIES TO INCLUDE HER DUTIES AND RESPONSIBILITIES AS LISTED IN HER JOB DESCRIPTION , FOR THE TWO BULLET POINTS LISTED THERE.

>> DO WE NEED TO HAVE THAT IN THERE?

>> I THINK -- >> DO WE NEED THIS ENTIRE

DOCUMENT? >> DUTIES AND RESPONSIBILITIES,

ARE THEY BOARD POLICY? >> NO POINT

>> YES. >> LOOK, MY SITUATION IS, I FEEL LIKE WE NEED TO HAVE CLEAR RULES OF WHAT OUR JOB IS AND WHAT HER JOB IS. I THINK THAT IF WE ARE GRADING HER OUT AND WE HAVE DUTIES AND RESPONSE ABILITIES LISTED IN BULLET POINTS AND THESE ARE WHAT SHE'S RESPONSIBLE FOR, WHY IS THAT NOT IN OUR BOARD POLICIES THAT WE GOVERN BY? I'VE HAD IT PUT IN MY FACE MORE THAN A FEW TIMES. I THINK THAT THIS IS

-- >> MONIQUE OR KAREN, DO YOU

WANT TO ADDRESS ? >> I'LL BE GLAD TO ADDRESS IT.

THIS IS A BOARD OPERATIONS POLICY BUT WITHIN THAT, IT ALWAYS HAS BEEN WITHIN THAT, AS DIRECTOR BAILEY POINTED OUT, THE DUTIES OF THE COMETS AS PRESIDENT GENERAL MANAGER, THE PRESIDENT CEO IS THE NEW TITLE, AND I THINK WHAT DIRECTOR BAILEY IS SAYING IS RATHER THAN THESE GENERAL BULLET POINTS , THAT WHILE WE ARE DEFINING THE ROLES OF THE BOARD AND THE PRESIDENT CEO, THAT THE PRESIDENT CEO IS MORE DETAILED THAN IT IS RIGHT NOW AND THAT DETAIL WOULD COME FROM THE JOB DESCRIPTION THAT I THINK HE'S PASSED OUT.

[02:20:07]

>> IT JUST THE BULLET POINTS UNDER ESSENTIAL DUTIES AND RESPONSIBILITIES OF WHAT HER JOB IS IS WHAT I AM ASKING TO BE PUT IN INSTEAD OF THE VAGUE GENERAL, I'VE NEVER HEARD MONIQUE BE CALLED GENERAL MANAGER, EITHER.

>> SHE'S GOING TO ASK RAISE WITH ALL THIS STUFF BEING PUT IN THERE. THAT WAS A JOKE, LIGHTEN UP.

>> COMMENTS ? >> YEAH, I MOVE THAT BE

INCLUDED. >> I WILL SECOND.

>> SEE, WE DID IT. >> ALL RIGHT.

>> WRITE THAT DOWN. >> YOU OWE HER ONE, BRAD.

>> OKAY. IT'S BEEN MOVED AND SECONDED TO UPDATE THE PRESIDENT GENERAL MANAGER AND I WILL TURN IT OVER TO MS.

DEMPSEY BEFORE WE VOTE . >> JUST VERY QUICKLY, THAT WAS ADOPTED BEFORE MONIQUE'S TITLE WAS CHANGED, THAT'S WHY IT'S PRESENT -- PRESIDENT JOHN MANAGER, 2022 OR 2021 IT WAS CHANGED TO PRESIDENT CEO. WHILE WE ARE MAKING CHANGES, WE CAN

SWAP THAT OUT. >> I WILL PUT THAT IN MY

MOTION. >> OKAY.

>> IT'S BEEN MOVED, SECONDED BY DIRECTOR GIBBS. TO ENSURE THAT THE VERBIAGE SAYS THAT, SIGNIFY BY SAYING I. MOTION PASSES. THOUGHTS? IF NOT? GOOD DISCUSSION. LET US GO TO

[20. Receive, consider and act upon an update regarding the Village Presidents' Council;]

AGENDA ITEM 20. RECEIVE, CONSIDER, AND ASK UPON AN UPDATE REGARDING THE VILLAGE PRESIDENTS COUNCIL, AND I WILL CALL ON OUR TREASURER , WHO ALSO CHAIRS THIS WITH DIRECTOR NELSON TO UPDATE US AND GIVE US A REPORT.

>> I WILL MAKE THIS IN THE TWO MINUTE RULE. WE HAD A VERY SUCCESSFUL PRESIDENTS COUNCIL MEETING.

>> OH, I GET THREE MINUTES? >> THIS IS THE 20TH AGENDA

ITEM SO HE GETS TWO. >> I'M ON IT.

>> I'M SORRY. >> ALL START AGAIN. WE HAD A VERY SUCCESSFUL PRESIDENTS COUNCIL MEETING. ALL PRESIDENTS OR THEIR DESIGNEES WERE PRESENT AT THE TIME. WE HAD OUR DIRECTOR OF COVENANT ENFORCEMENT GIVE A TERRIFIC PRESENTATION AND AM PLEASED TO SAY WE ALL LEARNED A LOT . I THINK IT WAS EXTREMELY EDUCATIONAL FOR THE VILLAGE PRESIDENTS TO KNOW AND BE ON THE COUNCIL AND ADVISE PEOPLE ON WHAT APPROACHES TO TAKE AND WHAT WAS IN AND OUT AND HOW TO GO ABOUT THE WHOLE PROCESS. I THOUGHT IT WAS WELL RECEIVED AND HAD GREAT QUESTIONS AND GREAT ANSWERS AND WE ALL LEARNED AN AWFUL LOT THAT EVENING. VERY SUCCESSFUL.

>> THANK YOU. >> WHO DO YOU HAVE SPEAKING

NEXT TIME? >> COMMISSIONER RILEY .

>> NICE JOB. >> THANK YOU. THAT BRINGS US

[23. Consideration of items to be placed on the agenda for next month's meeting;]

TAKE ACTION AT THIS TIME . THAT BRINGS US TO AGENDA ITEM 23, CONSIDERATION OF ITEMS TO BE PLACED ON THE AGENDA FOR NEXT MEETING. I DO HAVE SEVERAL. ONE, I HAVE SPOKEN TO OUR CEO, FACILITY UPDATE ON FIRE STATION FIVE , AS WELL AS TOWNHALL RENOVATION AND THE ADDITION TO PARKS AND RECREATION , AND THEN THE OTHER --

>> I WILL SECOND THOSE. >> THIRD.

>> OH, THAT'S RIGHT. SEE HOW THAT WORKS?

>> THE OTHER, THERE'S BEEN A LOT OF COVERAGE ABOUT THE WOODLANDS TOWNSHIP ENTRANCES TO THE 50TH ANNIVERSARY REVAMP AND THE TOWNSHIP , THE HOWARD HUGHES , THE COUNTY, AND SEVERAL ENTITIES HAVE BEEN WORKING ON THAT AND WOULD LIKE

AN UPDATE FOR THE BOARD. >> WAIT, I NEED A SECOND.

>> CAN I ADD TO THAT? THE SAME THING? THERE'S SOME, ESPECIALLY IN THE RESEARCH FORCE COURT ORDER THAT ARE LOOKING PRETTY 1980S . I WANT MY ENTRY SIGNS BACK. THEY NEED TO BE LOOKED AT AND HOPEFULLY THEY ARE PART OF THAT BUT I HAVE PICTURES OF TITLES FALLING OFF AND I HAVE NO IDEA WHO RUNS

THAT OR DOES THAT. >> OKAY. CINDY HEISER?

>> YES. I WANTED DAD SOMETHING, IT'S MY UNDERSTANDING THERE MIGHT BE FEDERAL FUNDING THE TOWNSHIP MAY QUALIFY FOR, SO I WOULD LIKE TO GET AN UPDATE ON THAT.

LASTS , IS THERE A POSSIBILITY OF US MONITORING THE FAULT LINE SENSE AS JRA SAYS THEY WILL NOT DO IT FOR TWO YEARS? I'D LIKE TO SEE IF THAT IS SOMETHING WE CAN DO AS A BOARD.

THERE. ONE IS UNDER THE LEGISLATION, WE HAVE TO FIGURE IF THAT FALLS UNDER THAT. IT'S NOT SOMETHING WE'VE DONE BEFORE. THE SECOND WOULD BE, OF COURSE, WHO DOES THAT , CONTRACT FOR THAT SERVICE AGREEMENT .

>> BUT IF WE COULD CHECK ON THAT, BECAUSE WE HAD HOPED TO DO IT TWICE A YEAR AND THEN THEY ARE COMING BACK SAYING THEY WILL DO IT EVERY TWO OR THREE YEARS. ARE THERE OTHER

AGENDA ITEMS? >> YEAH. I WILL SECOND THAT.

[24. Board announcements; and]
