TO THANK THE BOARD FOR THE TIME AND EFFORT Y'ALL GIVE TO THE CITIZENS AND RESIDENTS OF THE TOWNSHIP.

I APPRECIATE IT. IN TERMS OF ACCOUNTABILITY THE FIRST THING I WOULD LIKE TO START OFF WITH IS THAT THE LAST BOARD MEETING THERE WAS DISCUSSION ON THE ACCIDENT AT CREEKSIDE GREEN AND KIRK AND DALE AND IT WAS AGREED THAT THE TOWNSHIP WOULD FUND FOR OFF-DUTY POLICEMAN TO PATROL THAT INTERSECTION AND MAKE IT SAFE AND A MORE PERMANENT SOLUTION IS ENACTED. I WAS WONDERING THE STATUS ON THAT. HAS THAT OCCURRED AND IF IT HASN'T OCCURRED, WHEN ARE THE CONSTABLES OR POLICE OFFICERS GOING TO BE ON SITE PROTECTING THE KIDS CROSSING THE INTERSECTION? I WOULD ALSO, MY UNDERSTANDING FROM THE DISCUSSION LAST WEEK IS THE DEVELOPER FROM THAT AREA WAS RESPONSIBLE FOR THAT DESIGN OF THE ROADWAYS AND INTERSECTION. I AM WONDERING WHAT IS BEING DONE OR IS THAT BELLA BURR BEING HELD ACCOUNTABLE FOR THE POOR DESIGN? IS THAT DEVELOPER CONTRIBUTE IN TO THE FINAL SOLUTION TO FIX THAT AND MAKE IT MORE SAFE? ALSO IS THAT DEVELOPER STILL ABLE TO DEVELOP IN THE WOODLANDS? I THINK THAT IS AN UNDERLYING ISSUE AND WE NEED TO MAKE SURE THEY ARE HELD ACCOUNTABLE FOR THE DESIGNS THEY DO. THE OTHER QUESTION IS, WHAT DOES THE TOWNSHIP HAVE IN TERMS OF AUTHORITY TO ENFORCING THESE RULES AND IN HOLDING THE DEVELOPERS ACCOUNTABLE? THE OTHER QUESTION IS, IF WE WERE IN COOPERATED WOULD WE HAVE ANY DIFFERENT TOOLS AVAILABLE TO US TO HOLD THEM ACCOUNTABLE? THE OTHER QUESTION ON ACCOUNTABILITY THAT I HAD IS WHO HOLDS THE DEVELOPERS IN GENERAL ACCOUNTABLE? AT LAKE WOODLANDS AND LAKEFRONT CIRCLE THE HOWARD USED LANDINGS INTERSECTION THERE THERE IS NO BUFFER ZONE AND YOU SEE STRAIGHT INTO THE PARKING LOT AND APARTMENT BUILDINGS AND I THOUGHT THAT WAS ONE OF THE RESTRICTIONS WITHIN THE WOODLANDS FOR THE DEVELOPERS TO BLOCK THE VIEW OF THE BUILDINGS BEHIND IT.

THIS IS VERY PREVALENT ON THE NEW TRAILS ON THE NORTH SIDE OF RESEARCH FOREST. THERE'S A BUNCH OF BUILDINGS THAT YOU SEE FROM THE STREETS. IF I WANTED TO LIVE OFF 1,960 AND CHAMPION FOREST I COULD DO THAT BUT I CAME TO THE WOODLANDS AND ONE OF THE REASONS IS THIS ENVIRONMENT THAT WE HAVE. I AM JUST WONDERING, ONCE AGAIN, WHO IS RESPONSIBLE FOR ENFORCING THESE COVENANTS AND RESTRICTIONS IN THE SAME QUESTION IS, AS A TOWNSHIP, WHAT DO YOU ALL HAVE TO DO TO ENFORCE THIS? IF WE HAD INCORPORATING WOULD WE HAVE OTHER TOOLS WE COULD USE TO ADDRESS THIS? AND THE LAST QUESTION I HAD IS JUST AN DATE AT THE NOVEMBER 12 MEETING THERE WAS A LOT OF DISCUSSION AROUND THE COUNTY'S PLAN TO BUILD AN OVERPASS AT GROGAN'S MIDDLE RESEARCH FOREST.

THERE WAS A LOT OF DISCUSSION AND I'M WONDERING IF THERE WAS ANY DATE TO THAT DISCUSSION OR WHAT THE COUNTY IS PLANNING TO DO THERE IF YOU ALL COULD INFORM US ON THAT.

BUNCH. THAT CAME AS QUITE A SHOCK TO ME BECAUSE MR. BROWN WAS ON THE COMMITTEE AND I BELIEVE THAT MR. BONE OFFICE WAS ON THE COMMITTEE BUT THEY BASICALLY SAID IT'S KIND OF LIKE THE OLD MISSION IMPOSSIBLE TV SERIES WHERE THE GUY GOT A TAPE RECORDING AND SAYS IF YOU TAKE THIS MISSION AND GET CAUGHT WE WILL TAKE NO RESPONSIBILITY FOR YOUR ACTIONS. THAT'S KIND OF THE WAY THE TOWNSHIP ORDER HAS BEEN. I HAD A DISPUTE ABOUT A ZERO LOT LINE EASEMENT ON THE PATIO OWNED COMMUNITIES THAT HAVE

BEEN TRYING TO RESOLVE FOR A COUPLE OF YEARS AND SO FAR I'VE GOT IT DONE BUT I'M STILL WORKING ON IT.

COUPLE OF QUESTIONS, DO YOUR PEOPLE HAVE DNO INSURANCE? ASSUME. MR. NELSON DO YOU HAVE THAT INSURANCE? I WILL LET YOU CHECK WITH MR. ONE OTHER THING, MR. BUNCH IF YOU ARE GOING TO BE A POLITICIAN YOU'RE GOING TO HAVE TO LEARN HOW TO KISS A LOT OF BABIES.

THIS UGLY ONE YOU COULD HAVE KISSED AND YOU CHOSE NOT TO PURSUE THIS EASEMENT DEAL PROBLEM AND I KNOW I AM PRETTY UGLY BUT IF YOU CONTINUE TO IGNORE 2,500 RESIDENTS IS PROBABLY NOT IN YOUR BEST INTEREST.

FOR A 10 YEAR CAMPAIGN OF MISINFORMATION AND PROPAGANDA YOU ONLY GARNERED 7,932 VOTE FOR THE INCORPORATION.

ACCORDING TO THE WOODLANDS ONLINE $5 MILLION HAS BEEN SPENT. MAYBE IT IS THAT, MAYBE IT IS MORE AND MAYBE IT IS LESS FROM DAY ONE IT'S IN THE MILLIONS.

IF WE USE THAT FOR A BASE 7,932 VOTES DIVIDED BY 5 MILLION IS $,630 PER VOTE AND THAT'S PATHETIC.

I HAVE A COPY OF THE IMPACT MAGAZINE.

ON THE FRONT PAGE IT SAYS THE CORPORATION FAILED.

THERE IS A LIST OF RESIDENTS WHO SUPPORTED PRESERVE THE WOODLANDS AND I DON'T SEE ONE MEMBER OF THE BOARD'S NAME ON THEIR MY NAME IS ON THERE AND A LOT OF OTHER RESIDENTS.

I AM LOOKING AT THE WOODLANDS TOWNSHIP BOARD WEBSITE AND THERE'S NOT ONE WORD ABOUT THE DEFEAT, ABOUT THE ELECTION.

IF YOU WERE TO LOOK AT IT YOU WOULD AN THERE WAS NEVER AN ELECTION HELD. SO, THE RESIDENCE OF THE WOODLANDS DESERVE AN APOLOGY FROM YOU PEOPLE WITH A FRONT PAGE LETTER STATING THAT YOU SUFFERED A HUMILIATING DEFEAT AND WE WANT TO KNOW WHAT IS THE TOTAL AMOUNT SPENT ON THIS

AND, MY SECOND QUESTION IS, WHY WOULD YOU PUT THE ELECTION IN AN OFF YEAR ELECTION WITH A 7 TO 8 PERCENT TURNOUT? AND THEN YOU VOTED IT IN ON AUGUST 13TH AT 3:30, THE LAST DAY AT THE LAST HOUR TO PUT IT ON THE BALLOT FOR THAT ELECTION.

IT SHOWS ME THAT SOMETHING IS WRONG.

EVERYONE OF YOU SHOULD BE ASHAMED OF WHAT YOU HAVE DONE.

WE DO NOT HAVE CONFIDENCE IN ANY OF THE BOARD MEMBERS AND I THINK THE BEST WAY GOING TOWARD IS WE WANT YOU TO RESIGN ANYONE THAT HAS PARTICIPATED IN THIS ENDEAVOR.

I WILL CLOSE WITH THIS COMMENT. TO ALL OF THE RESIDENTS IN THE WOODLANDS, IF YOU OUGHT TO 21 WAS A WILD RIDE, WAIT UNTIL NEXT YEAR. I THINK 2,022 IS GOING TO BE A WILD RIDE BECAUSE I PUT NOTHING PAST THIS BOARD AND WHAT Y'ALL WILL DO. SO SHAME ON EVERYONE OF YOU.

WERE MERRILY WE EXIST TO PROMOTE JOB GROWTH IN THE ECONOMIC VITALITY OF OUR COMMUNITY AND WE DO THAT THROUGH RECRUITING NEW COMPANIES AND SUPPORTING EXISTING BUSINESSES IN OUR JOB RETENTION AND EXPANSION.

THERE'S OUR SERVICE AREA THE WOODLANDS AREA AS IT IS DEFINED AND IT HAS BEEN THAT WAY SINCE OUR INCEPTION IN 1997.

PRIMARILY WE CONCERN OURSELVES OF COURSE WITH THE WOODLANDS TOWNSHIP, THE CITIES OF SHENANDOAH, OAK RIDGE NORTH AND UNINCORPORATED PART OF MONTGOMERY COUNTY.

AS YOU DO, WE PROMOTE THIS VERY MUCH AS THE BEST CITY TO RAISE A FAMILY WITH THE BEST CITY TO LIVE IN AMERICA.

PROJECT GOLDEN SCRIPTS IS BIO LIFE-SCIENCES COMPANY FROM CALIFORNIA WHO HAS CONSIDERED COMING TO THE WOODLANDS WITH THEIR HEADQUARTERS AND JEAN THERAPY PROGRAM.

THEY WOULD INVEST $56 MILLION AND BRING 125 JOBS WITH AN AVERAGE SALARY OF $125,000. WE ARE HOPEFUL THAT WILL HAPPEN SOON. THE ONE THAT YOU SEE ALSO, THAT HAS COME TO FRUITION AND HAS BEEN ANNOUNCED IS PROJECT AND WHY DIG NOW A TENANT OVER AT THE WATERWAY TOWER.

WE CALL THEM COIN TECHNOLOGY BECAUSE WE COULD NOT COME UP WITH ANYTHING BETTER THAN THAT THEY ARE CALLING THE WOODLANDS A PLACE OF OPERATION FOR THE BITCOIN TECHNOLOGY WITH FINANCIAL ENTITIES. OBVIOUSLY WE ARE NOT GOING TO LAND EVERYONE OF THOSE PROJECTS.

I CAN TELL YOU THIS, THIS IS A FIVE-YEAR HIGH FOR US.

THIS IS BETTER THAN THE PREVIOUS FIVE YEARS SO WE GO BEFORE THE PANDEMIC IN LOOKING AT THESE IF WE LENDED THEM ALL 1800 NEW JOBS APPROXIMATELY WOULD BE IN OUR COMMUNITY.

YOU CAN SEE THIS ONE WAS A COMPETITIVE SCORING JUST BELOW THEM AND THIS IS A FIRM BASED OUT OF HOUSTON AND WERE PRETTY FAMILIAR WITH THEM THEY HAVE SUBMITTED A NUMBER OF TIMES FOR PROPOSALS AND HAVE RECEIVED WORK FROM US BUT THEY SCORED HIGH IN THIS PROCESS. THEY ARE JOINED WITH PROS CONSULTING WHICH IS A BIG PARKS AND RECREATION FIRM AS WELL.

THE LITTLE CAVEAT WITH THE RFP AND HOW THESE THINGS WORK IS THAT THE TEXAS PROCUREMENT ACT PREVENTS US FROM SELECTING BASED ON PRICE AND SO, THE GOAL WITH THIS IS TO NEGOTIATE AND HAVE THE PRESIDENT AND GENERAL MANAGER NEGOTIATE AND NOT TO EXCEED THE WIDGET AMOUNT. IF WE GET INTO A SITUATION WHERE WE CAN GET THAT AMOUNT APPROVED WE WOULD GO TO THE SECOND VENDOR AND THIRD VENDOR AS WELL.

THE TIMELINE IS A QUICK TURNAROUND IF APPROVED TONIGHT WE WILL START WORKING THE CONTRACT TO GET THAT EXECUTED AND GO INTO THE PUBLIC PROCESS IN BETWEEN JANUARY AND APRIL WHICH WILL BE WITH WEB-BASED SURVEYS, PUBLIC MEETING AND COMMUNITY-BASED GROUPS. WE WILL HAVE A PRELIMINARY STUDY IN MAY AND THEN A FINAL STUDY IN JUNE OR JULY, IN TIME FOR YOU IF THERE'S ANY BUDGET CONSIDERATIONS BEING MADE 2023 THEY COULD BE INCLUDED IN THAT. THEN SINCE WE INITIALLY STARTED THE SERVICE IN AUGUST OF 2020 BUT DUE TO COVID WE BEEN DELAYING, DELAYING AND DELAYING.

WHAT THIS PRESENTATION IS REFERRING TO IS A SETTLEMENT AGREEMENT THAT THE TEXAS ATTORNEY GENERAL HAS INTRODUCED WITH THE COALITION OF OTHER STATE WITH OPIOID MANUFACTURERS AND DISTRIBUTORS RELATED TO THE IMPACT THEY'VE HAD ON LOCAL COMMUNITIES AND THE MONEY THAT THOSE COMMITTEES WILL NOW BE ABLE TO RECEIVE SHOULD THEY CHOOSE TO JOIN THE SETTLEMENT.

AND IN THIS SAKE OF TIME WILL START OUT BY SAYING THE TOWNSHIP DOES NOT QUALIFY AS A DIRECT RECIPIENT UNDER THE SETTLEMENT AGREEMENT. WE WILL QUALIFY SHOULD THE BOARD CHOOSE TO JOIN THE SETTLEMENT AS FOR OPIOID ABATEMENT FUNDING FROM THE STATE COUNSEL IN A LATER TIME IF THEY WOULD CHOOSE TO DO SO. I WILL RUN THROUGH THIS QUICKLY AND GIVE YOU AN OVERVIEW THIS IS INFORMATION PROVIDED BY THE TEXAS ATTORNEY GENERAL'S OFFICE AND PRESENTATIONS THEY BEEN DOING TO POLITICAL SUBDIVISIONS ACROSS THE STATE.

OBVIOUSLY YOU'VE HEARD IN THE NEWS AND WE KNOW IS SIGNIFICANT THE IMPACT OPIOID OVERDOSES HAVE HAD ON OUR COMMUNITIES ACROSS THE COUNTRY. THESE ARE FAIRLY STAGGERING.

THE TEXAS INCREASE IN OVERDOSE S IN 2020 PRIMARILY DRIVEN BY OPIOID OVERDOSES I WILL REPORT GOOD NEWS IN THAT REGARDS TO THE TOWNSHIP AND CONSULTATION WITH THE FIRE DEPARTMENT THE FIRE DEPARTMENT HAS USED NARCAN WHICH COUNTERACTS OPIOID OVERDOSE SYMPTOMS IN PATIENTS 20 TIMES SINCE JANUARY OF 2020.

IF YOU THINK ABOUT THE NUMBER OF CALLS THAT THE FIRE DEPARTMENT MAY GO THROUGH IN A GIVEN YEAR IN A TWO-YEAR PERIOD WE'VE ONLY HAD 20 WHERE NARCAN WAS ADMINISTERED IN IN SOME CASES IT'S CARDIAC ARREST WHERE THEY'RE NOT SURE IF AN OPIOID OR OVERDOSE IS THE UNDERLYING PROBLEM.

WE HAVE HAD A RELATIVELY MINOR IMPACT WHEN IT COMES TO OUR ACTUAL EMERGENCY MEDICINE HERE IN THE TOWNSHIP DIRECTLY.

THIS IS JUST A QUICK TIMELINE TO SHOW THAT THE STATES HAVE BEEN INVESTIGATING AT THE DISTRIBUTORS AND MANUFACTURERS SOME TIME NOW STARTING IN 2017 AND CULMINATING WITH THE AGREEMENTS THAT WERE REACH THE SUMMER AS IT RELATES TO THE SETTLEMENT. IN JULY THE ATTORNEY GENERAL ANNOUNCED THAT A COALITION OF STATES HAD REACHED AN AGREEMENT IN AUGUST THE ATTORNEY GENERAL ANNOUNCED TEXAS WILL BE JOINING THE SETTLEMENT AGREEMENT AND THEREFORE WILL BE ELIGIBLE FOR FUNDING FOR THE AGREEMENT UP TO $1.2 MILLION FROM THE DISTRIBUTORS AND THEN IN OCTOBER THEY ANNOUNCED THAT THEY HAD ALSO REACHED AN AGREEMENT WITH JOHNSON AND JOHNSON AS A MANUFACTURER WHICH BRINGS THE STATE 'S POTENTIAL TOTAL TO $1.5 BILLION. MOST OF THOSE PAYMENTS OCCUR OVER 18 YEARS BUT A SIGNIFICANT AMOUNT OF THOSE PAYMENTS ARE FRONTLOADED IN ORDER TO GET THEM TO JOIN THE AGREEMENT.

AS I MENTIONED TEXAS COULD RECEIVE UP TO 1.5 WILLIAM DOLLARS FOR OPIOID ABATEMENT ASSUMING AND THIS IS ALL DEPENDING ON THE NUMBER OF POLITICAL SUBDIVISIONS IN THE STATE CHOOSE TO JOIN ESTATE IN THE AGREEMENT THAT ALSO INCLUDES SOME INJUNCTIVE RELIEF HITTING DISTRIBUTORS OR REQUIRING DISTRIBUTORS TO HAVE SOME ADDITIONAL CLEARINGHOUSE AND SUSPICIOUS ACTIVITY REGULATION AS WELL AS PREVENTING JOHNSON AND JOHNSON FROM ACTUALLY MANUFACTURING, OR SELLING OPIOIDS FOR A 10 YEAR PERIOD.

THE GOAL IS TO BRING AS MUCH MONEY TO TEXAS AS POSSIBLE IN THE STATE HAS BEEN ASKING LOCAL POLITICAL SUBDIVISIONS TO CONSIDER JOINING THE SETTLEMENT AGREEMENT IN ORDER TO MAXIMIZE THE NUMBER OF FUNDS AVAILABLE. HOW IS THAT DETERMINED? IT IS DETERMINED BY THE SETTLEMENT AGREEMENT AND SOMETHING CALLED THE TEXAS TERM SHEET WHICH IS ALSO QUALIFIED BY THE LEGISLATURE AND STATE LEGISLATION AND CREATES WHAT IS CALLED THE TEXAS OPIOID COUNSEL.

THERE ARE ESSENTIALLY TWO POTS OF MONEY FUNDS THE GO TO VOCAL PCOMMUNITIES FOR ABATEMENT PROGRAMS DIRECTLY IN THE OPIOID COUNSEL WHAT MONIES MADE AVAILABLE BY REGION WHICH OTHER JURISDICTIONS WHICH DON'T RECEIVE DIRECT PAYMENTS IN ADDITION TO THOSE THAT DO MAY BE FULLY ABLE TO APPLY FOR GRANTS FOR ABATEMENT ACTIVITIES.

AS I SAID EARLIER WE ARE NOT INCLUDED IN THE TEXAS TERM SHEET BUT WE WOULD BE ELIGIBLE TO BE FUNDED THROUGH GRANT FUNDING SHOULD THE BOARD CHOOSE TO JOIN.

THESE ARE SOME OF THE ALLOCATIONS FROM THE TERM SHEET TO GIVE YOU AN IDEA OF WHAT'S GOING ON IN THE REGION.

HARRIS COUNTY WOULD RECEIVE A SIGNIFICANT PORTION OF MONEY AND CONNOR WOULD BE ELIGIBLE FOR 500,000 STEM A SIGNIFICANT PORTION WOULD RECEIVE THREE AND A 21,000 IN THE BIG NUMBER AT THE BOTTOM THE OPIOID COUNSEL REGION INCLUDING OUR AREA WOULD BE $23 MILLION AND THAT'S WHERE WE WOULD GO GRANT ENDING SHOULD THE BOARD BE INCLUDING THE GRANT SETTLEMENT.

THE FUNDS CAN BE USED FOR A WIDE ARRAY OF ABATEMENT USES.

THERE ARE SOME CORE STRATEGIES THAT ARE SUGGESTED AND RECOMMENDED. SEVERAL SUBCATEGORIES UNDER EACH OF THOSE ON HOW THE MONEY CAN BE USED AS WELL AS APPROVED USES FOR TREATMENT PREVENTION AND THE ONE THAT WOULD APPLY TO TOWNSHIP BECAUSE WE DON'T HAVE THE AUTHORITY OR DO THE ACTIVITIES THAT YOU WOULD SEE IN THE CORE STRATEGIES WOULD BE THE EDUCATION AND WELLNESS SUPPORT FOR THE RESPONDERS.

THAT WOULD BE SOMETHING LIKE GRANT FUNDING COULD BE USED IN THE FUTURE. THE QUESTION BEFORE THE BOARD TONIGHT WOULD BE WHETHER THE BOARD WOULD CHOOSE TO WANT TO JOIN THE STATE SETTLEMENT AGREEMENT AND LOCAL JURISDICTIONS HAVE UNTIL JANUARY SECOND TO NOTIFY THE STATE. IF YOU CHOOSE TO JOIN YOU WOULD PRECLUDE ANY FUTURE LITIGATION RELATED TO THE MANUFACTURERS OR DISTRIBUTORS IS ESSENTIALLY WHAT YOU'RE GIVING UP FOR THE PAYMENTS AND DURING THE SETTLEMENT.

WE HAVE NO ACTIVE CASES AND I CANNOT FOR SEE US HAVING ANY BUT THAT WOULD BE A CONDITION OF THE AGREEMENT.

OAK RIDGE NORTH HAS NOT THERE PAYMENT WAS LIKE $300.

AGAIN IN CITIES LIKE WINGHAM AND OTHERS ARE REPORTING MUCH HIGHER NUMBERS. THERE ARE SOME COMMUNITIES LIKE BEXAR COUNTY HAS NOT JOINED THE SUIT BECAUSE THEY BELIEVE A LITIGATION SETTLEMENT WILL BE MUCH HIGHER FOR THEM THAN JOINING IN THE MASTER SETTLEMENT.

FOR THE COMMUNITIES THAT HAVE SMALL POTS OF MONEY I HAVE NOT SEEN A REPORT ON HOW THEY INTEND TO USE THE FUNDS YET.

>> I'VE ALSO SEEN MENTIONED THAT SOME COMMUNITIES ARE THINKING OF SUING THE FEDERAL GOVERNMENT FOR THE OPIOIDS COMING ACROSS THE BORDER. I DON'T KNOW IF YOU HAVE HEARD ANYTHING LIKE THAT BUT THERE ISN'T A LIMIT FOR WHERE PEOPLE GET THEIR OPIOIDS. IT'S NOT JUST COMING FROM MANUFACTURERS IN THE UNITED STATES.
